| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter B, Chapter 31, |
|---|
| 11 | 11 | | Election Code, is amended to read as follows: |

| 12 | 12 | | SUBCHAPTER B. COUNTY ELECTIONS ADMINISTRATOR IN CERTAIN COUNTIES |

| 13 | 13 | | SECTION 2. Section 31.031(a), Election Code, is amended to |
|---|
| 14 | 14 | | read as follows: |

| 15 | 15 | | (a) The commissioners court of a county with a population of |
|---|
| 16 | 16 | | one million or less by written order may create the position of |
|---|
| 17 | 17 | | county elections administrator for the county. |
|---|
| 18 | 18 | | SECTION 3. Subchapter B, Chapter 31, Election Code, is |
|---|
| 19 | 19 | | amended by adding Section 31.050 to read as follows: |
|---|
| 20 | 20 | | Sec. 31.050. ABOLISHMENT OF POSITION AND TRANSFER OF DUTIES |
|---|
| 21 | 21 | | IN CERTAIN COUNTIES. On September 1, 2023, all powers and duties of |
|---|
| 22 | 22 | | the county elections administrator of a county with a population of |
|---|
| 23 | 23 | | more than one million under this subchapter are transferred to the |
|---|
| 24 | 24 | | county tax assessor-collector and county clerk. The county tax |
|---|
| 25 | 25 | | assessor-collector shall serve as the voter registrar, and the |
|---|
| 26 | 26 | | duties and functions of the county clerk that were performed by the |
|---|
| 27 | 27 | | administrator revert to the county clerk, unless a transfer of |
|---|
| 28 | 28 | | duties and functions occurs under Section 12.031 or 31.071. |
|---|
| 29 | 29 | | SECTION 4. On the effective date of this Act, a county that |
|---|
| 30 | 30 | | has a county elections administrator and a population of more than |
|---|
| 31 | 31 | | one million shall transfer employees, property, and records as |
|---|
| 32 | 32 | | necessary to accomplish the abolishment of the position of county |
|---|
| 33 | 33 | | elections administrator under this Act. |

| 34 | 34 | | SECTION 5. This Act takes effect September 1, 2023. |
