77 relating to abolishing the county elections administrator position
88 in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter B, Chapter 31,
1111 Election Code, is amended to read as follows:
1212 SUBCHAPTER B. COUNTY ELECTIONS ADMINISTRATOR IN CERTAIN COUNTIES
1313 SECTION 2. Section 31.031(a), Election Code, is amended to
1414 read as follows:
1515 (a) The commissioners court of a county with a population of
1616 one million or less by written order may create the position of
1717 county elections administrator for the county.
1818 SECTION 3. Subchapter B, Chapter 31, Election Code, is
1919 amended by adding Section 31.050 to read as follows:
2020 Sec. 31.050. ABOLISHMENT OF POSITION AND TRANSFER OF DUTIES
2121 IN CERTAIN COUNTIES. On September 1, 2023, all powers and duties of
2222 the county elections administrator of a county with a population of
2323 more than one million under this subchapter are transferred to the
2424 county tax assessor-collector and county clerk. The county tax
2525 assessor-collector shall serve as the voter registrar, and the
2626 duties and functions of the county clerk that were performed by the
2727 administrator revert to the county clerk, unless a transfer of
2828 duties and functions occurs under Section 12.031 or 31.071.
2929 SECTION 4. On the effective date of this Act, a county that
3030 has a county elections administrator and a population of more than
3131 one million shall transfer employees, property, and records as
3232 necessary to accomplish the abolishment of the position of county
3333 elections administrator under this Act.
3434 SECTION 5. This Act takes effect September 1, 2023.
