55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the criminal offense of sexual
88 assault.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.011(b), Penal Code, is amended to
1111 read as follows:
1212 (b) A sexual assault under Subsection (a)(1) is without the
1313 consent of the other person if:
1414 (1) the actor compels the other person to submit or
1515 participate by the use of physical force, violence, or coercion;
1616 (2) the actor compels the other person to submit or
1717 participate by threatening to use force or violence against the
1818 other person or to cause harm to the other person, and the other
1919 person believes that the actor has the present ability to execute
2020 the threat;
2121 (3) the other person has not consented and the actor
2222 knows the other person is unconscious or physically unable to
2323 resist;
2424 (4) the actor knows that as a result of mental disease
2525 or defect the other person is at the time of the sexual assault
2626 incapable either of appraising the nature of the act or of resisting
2727 it;
2828 (5) the other person has not consented and the actor
2929 knows the other person is unaware that the sexual assault is
3030 occurring;
3131 (6) the actor has intentionally impaired the other
3232 person's power to appraise or control the other person's conduct by
3333 administering any substance without the other person's knowledge;
3434 (7) the actor compels the other person to submit or
3535 participate by threatening to use force or violence against any
3636 person, and the other person believes that the actor has the ability
3737 to execute the threat;
3838 (8) the actor is a public servant who coerces the other
3939 person to submit or participate;
4040 (9) the actor is a mental health services provider or a
4141 health care services provider who causes the other person, who is a
4242 patient or former patient of the actor, to submit or participate by
4343 exploiting the other person's emotional dependency on the actor;
4444 (10) the actor is a clergyman who causes the other
4545 person to submit or participate by exploiting the other person's
4646 emotional dependency on the clergyman in the clergyman's
4747 professional character as spiritual adviser;
4848 (11) the actor is an employee of a facility where the
4949 other person is a resident, unless the employee and resident are
5050 formally or informally married to each other under Chapter 2,
5151 Family Code;
5252 (12) the actor is a health care services provider who,
5353 in the course of performing an assisted reproduction procedure on
5454 the other person, uses human reproductive material from a donor
5555 knowing that the other person has not expressly consented to the use
5656 of material from that donor;
5757 (13) the actor is a coach or tutor who causes the other
5858 person to submit or participate by using the actor's power or
5959 influence to exploit the other person's dependency on the actor;
6060 [or]
6161 (14) the actor is a caregiver hired to assist the other
6262 person with activities of daily life and causes the other person to
6363 submit or participate by exploiting the other person's dependency
6464 on the actor; or
6565 (15) the actor is a mental health services provider, a
6666 health care services provider, or a person who purports to be a
6767 health care services provider and:
6868 (A) the actor creates or confirms a false
6969 impression of law or fact that the actor knows or has reason to
7070 believe is false; and
7171 (B) the other person submits or participates on
7272 the basis of the false impression.
7373 SECTION 2. Section 22.011(c)(3), Penal Code, is amended to
7474 read as follows:
7575 (3) "Health care services provider" means a person who
7676 is licensed, certified, or otherwise authorized by the laws of this
7777 state to provide health care services in the ordinary course of
7878 business or practice of a profession, including:
7979 (A) a physician licensed under Subtitle B, Title
8080 3, Occupations Code;
8181 (B) a chiropractor licensed under Chapter 201,
8282 Occupations Code;
8383 (C) a physical therapist licensed under Chapter
8484 453, Occupations Code;
8585 (D) a physician assistant licensed under Chapter
8686 204, Occupations Code; or
8787 (E) a registered nurse, a vocational nurse, or an
8888 advanced practice nurse licensed under Chapter 301, Occupations
8989 Code.
9090 SECTION 3. The changes in law made by this Act apply only to
9191 an offense committed on or after the effective date of this Act. An
9292 offense committed before the effective date of this Act is governed
9393 by the law in effect when the offense was committed, and the former
9494 law is continued in effect for that purpose. For purposes of this
9595 section, an offense was committed before the effective date of this
9696 Act if any element of the offense occurred before that date.
9797 SECTION 4. This Act takes effect September 1, 2023.
