| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle A, Title 10, Business & Commerce Code, |
|---|
| 11 | 11 | | is amended by adding Chapter 307 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 307. DISCLOSURES RELATING TO TELECOMMUNICATIONS SERVICES |
|---|
| 13 | 13 | | Sec. 307.001. DEFINITION. In this chapter, "mobile |
|---|
| 14 | 14 | | telephone" includes a cellular telephone or similar wireless |
|---|
| 15 | 15 | | communication device that can be used as a telephone. |
|---|
| 16 | 16 | | Sec. 307.002. DISCLOSURES REQUIRED. (a) A provider of |
|---|
| 17 | 17 | | mobile telephone service shall annually disclose on the provider's |
|---|
| 18 | 18 | | Internet website all charges, fees, assessments, surcharges, and |
|---|
| 19 | 19 | | taxes collected by the provider in connection with the service |
|---|
| 20 | 20 | | provided. |
|---|
| 21 | 21 | | (b) A disclosure under Subsection (a) must identify: |
|---|
| 22 | 22 | | (1) the entity that imposes the charge, fee, |
|---|
| 23 | 23 | | assessment, surcharge, or tax; and |
|---|
| 24 | 24 | | (2) the allocation of the charge, fee, assessment, |
|---|
| 25 | 25 | | surcharge, or tax revenue collected. |
|---|
| 26 | 26 | | SECTION 2. Subchapter A, Chapter 64, Utilities Code, is |
|---|
| 27 | 27 | | amended by adding Section 64.005 to read as follows: |
|---|
| 28 | 28 | | Sec. 64.005. DISCLOSURES REQUIRED. (a) A billing utility |
|---|
| 29 | 29 | | shall annually disclose on the utility's Internet website all |
|---|
| 30 | 30 | | charges, fees, assessments, surcharges, and taxes collected by the |
|---|
| 31 | 31 | | utility in connection with the telecommunications product or |
|---|
| 32 | 32 | | service provided. |
|---|
| 33 | 33 | | (b) A disclosure under Subsection (a) must identify: |
|---|
| 34 | 34 | | (1) the entity that imposes the charge, fee, |
|---|
| 35 | 35 | | assessment, surcharge, or tax; and |
|---|
| 36 | 36 | | (2) the allocation of the charge, fee, assessment, |
|---|
| 37 | 37 | | surcharge, or tax revenue collected. |

| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
