66 AN ACT
77 relating to the disclosure of charges, fees, assessments,
88 surcharges, and taxes collected by a telecommunications provider.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 10, Business & Commerce Code,
1111 is amended by adding Chapter 307 to read as follows:
1212 CHAPTER 307. DISCLOSURES RELATING TO TELECOMMUNICATIONS SERVICES
1313 Sec. 307.001. DEFINITION. In this chapter, "mobile
1414 telephone" includes a cellular telephone or similar wireless
1515 communication device that can be used as a telephone.
1616 Sec. 307.002. DISCLOSURES REQUIRED. (a) A provider of
1717 mobile telephone service shall annually disclose on the provider's
1818 Internet website all charges, fees, assessments, surcharges, and
1919 taxes collected by the provider in connection with the service
2020 provided.
2121 (b) A disclosure under Subsection (a) must identify:
2222 (1) the entity that imposes the charge, fee,
2323 assessment, surcharge, or tax; and
2424 (2) the allocation of the charge, fee, assessment,
2525 surcharge, or tax revenue collected.
2626 SECTION 2. Subchapter A, Chapter 64, Utilities Code, is
2727 amended by adding Section 64.005 to read as follows:
2828 Sec. 64.005. DISCLOSURES REQUIRED. (a) A billing utility
2929 shall annually disclose on the utility's Internet website all
3030 charges, fees, assessments, surcharges, and taxes collected by the
3131 utility in connection with the telecommunications product or
3232 service provided.
3333 (b) A disclosure under Subsection (a) must identify:
3434 (1) the entity that imposes the charge, fee,
3535 assessment, surcharge, or tax; and
3636 (2) the allocation of the charge, fee, assessment,
3737 surcharge, or tax revenue collected.
3838 SECTION 3. This Act takes effect September 1, 2023.
