55 AN ACT
66 relating to compliance with minimum safety standards as a condition
77 for the issuance of tax-supported bonds by school districts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 45, Education Code, is
1010 amended by adding Section 45.0012 to read as follows:
1111 Sec. 45.0012. SAFETY STANDARDS AS CONDITION FOR ISSUANCE OF
1212 TAX-SUPPORTED BONDS.
1313 (a) Before issuing bonds described by Section 45.001, a
1414 school district must demonstrate to the agency, including the
1515 provisions of written assurances, that the district has satisfied
1616 at least one of the following conditions:
1717 (1) School buildings and other district facilities
1818 comply with minimum safety standards as determined by commissioner
1919 rule; or
2020 (2) Proceeds from the bonds to be sold will be used to
2121 achieve compliance with the minimum safety standards determined by
2222 commissioner rule.
2323 (b) A school district is required to comply with an
2424 assurance provided to the agency under Subsection (a)(2).
2525 SECTION 2. This Act takes effect September 1, 2023.
