| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 45, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 45.0012 to read as follows: |
|---|
| 11 | 11 | | Sec. 45.0012. SAFETY STANDARDS AS CONDITION FOR ISSUANCE OF |
|---|
| 12 | 12 | | TAX-SUPPORTED BONDS. |
|---|
| 13 | 13 | | (a) Before issuing bonds described by Section 45.001, a |
|---|
| 14 | 14 | | school district must demonstrate to the agency, including the |
|---|
| 15 | 15 | | provisions of written assurances, that the district has satisfied |
|---|
| 16 | 16 | | at least one of the following conditions: |
|---|
| 17 | 17 | | (1) School buildings and other district facilities |
|---|
| 18 | 18 | | comply with minimum safety standards as determined by commissioner |
|---|
| 19 | 19 | | rule; or |
|---|
| 20 | 20 | | (2) Proceeds from the bonds to be sold will be used to |
|---|
| 21 | 21 | | achieve compliance with the minimum safety standards determined by |
|---|
| 22 | 22 | | commissioner rule. |
|---|
| 23 | 23 | | (b) A school district is required to comply with an |
|---|
| 24 | 24 | | assurance provided to the agency under Subsection (a)(2). |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
