| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 485A.101, Government Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | Sec. 485A.101. CRITERIA FOR MEDIA PRODUCTION DEVELOPMENT |
|---|
| 11 | 11 | | ZONE RECOGNITION. To be approved as a media production development |
|---|
| 12 | 12 | | zone, an area: |
|---|
| 13 | 13 | | (1) must be in a metropolitan statistical area, the |
|---|
| 14 | 14 | | principal municipality of which[: |
|---|
| 15 | 15 | | [(A) has a population of more than 250,000; and |
|---|
| 16 | 16 | | [(B)] has the adequate workforce, |
|---|
| 17 | 17 | | infrastructure, facilities, or resources to support the production |
|---|
| 18 | 18 | | and completion of moving image projects; |
|---|
| 19 | 19 | | (2) must be recognized as a media production |
|---|
| 20 | 20 | | development zone by ordinance or order, as appropriate, of a |
|---|
| 21 | 21 | | municipality or the commissioners court of a county; and |
|---|
| 22 | 22 | | (3) will contain a qualified media production location |
|---|
| 23 | 23 | | within its geographical boundaries that meets the criteria under |
|---|
| 24 | 24 | | Section 485A.102. |
|---|
| 25 | 25 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to an application for designation submitted under Section 485A.106, |
|---|
| 27 | 27 | | Government Code, on or after the effective date of this Act. An |
|---|
| 28 | 28 | | application submitted before the effective date of this Act is |
|---|
| 29 | 29 | | governed by the law in effect on the date the application was |
|---|
| 30 | 30 | | submitted, and the former law is continued in effect for that |
|---|
| 31 | 31 | | purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2023. |
