| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 551.050, Government Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 551.050. [MUNICIPAL GOVERNMENTAL BODY:] PLACE AND |
|---|
| 13 | 13 | | MEANS OF POSTING NOTICE. |
|---|
| 14 | 14 | | SECTION 2. Section 551.050, Government Code, is amended by |
|---|
| 15 | 15 | | adding Subsections (c) and (d) to read as follows: |

| 16 | 16 | | (c) The validity of a notice posted on an electronic |
|---|
| 17 | 17 | | bulletin board by a governmental body that made a good faith attempt |
|---|
| 18 | 18 | | to comply with the requirements of Section 551.043 is not affected |
|---|
| 19 | 19 | | by a failure to comply with a requirement of this section that is |
|---|
| 20 | 20 | | due to a technical problem beyond the governmental body's control. |
|---|
| 21 | 21 | | (d) If another law requires a governmental body to post |
|---|
| 22 | 22 | | notice, on a bulletin board or otherwise, the governmental body may |
|---|
| 23 | 23 | | comply with that law through the use of an electronic bulletin |
|---|
| 24 | 24 | | board. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
