| 5 | 5 | | relating to the renewal of certain expired certificates issued by |

| 6 | 6 | | the Texas Commission on Fire Protection; authorizing a fee. |
|---|
| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 419.0341, Government Code, is amended by |
|---|
| 9 | 9 | | amending Subsection (e) and adding Subsection (e-1) to read as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | (e) If the person's certificate has been expired for more |
|---|
| 12 | 12 | | than five years [one year or longer], the person may not renew the |
|---|
| 13 | 13 | | certificate. The person may obtain a new certificate by submitting |
|---|
| 14 | 14 | | to the proficiency examination or repeating the requirements and |
|---|
| 15 | 15 | | procedures for obtaining an original certificate. The commission |
|---|
| 16 | 16 | | shall charge a fee to cover the cost of administering the |
|---|
| 17 | 17 | | proficiency examination. |
|---|
| 18 | 18 | | (e-1) If the person's certificate has been expired for more |
|---|
| 19 | 19 | | than one year but not more than five years, the person may renew the |
|---|
| 20 | 20 | | certificate in accordance with rules established by the commission. |
|---|
| 21 | 21 | | The commission by rule shall establish: |
|---|
| 22 | 22 | | (1) a system for renewing a certificate under this |
|---|
| 23 | 23 | | subsection; |
|---|
| 24 | 24 | | (2) a list of criteria a person must satisfy to renew a |
|---|
| 25 | 25 | | certificate under this subsection; and |
|---|
| 26 | 26 | | (3) a fee for renewing a certificate under this |
|---|
| 27 | 27 | | subsection. |
|---|
| 28 | 28 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 29 | 29 | | a certificate that expires in accordance with rules adopted by the |
|---|
| 30 | 30 | | Texas Commission on Fire Protection under Section 419.033, |
|---|
| 31 | 31 | | Government Code, on or after January 1, 2024. A certificate that |
|---|
| 32 | 32 | | expires before January 1, 2024, is governed by the law in effect |
|---|
| 33 | 33 | | immediately before the effective date of this Act, and the former |
|---|
| 34 | 34 | | law is continued in effect for that purpose. |
|---|
| 35 | 35 | | SECTION 3. Not later than January 1, 2024, the Texas |
|---|
| 36 | 36 | | Commission on Fire Protection shall adopt rules providing for the |
|---|
| 37 | 37 | | renewal of a certificate under Section 419.0341(e-1), Government |
|---|
| 38 | 38 | | Code, as added by this Act. |
|---|
| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2023. |
