6 | 6 | | relating to the salary step credit for a certified career and |
---|
7 | 7 | | technology education teacher. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 21.403, Education Code, is amended to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | (a) A teacher, librarian, school counselor, or nurse shall |
---|
12 | 12 | | advance one step on the minimum salary schedule under Section |
---|
13 | 13 | | 21.402 for each year of experience as a teacher, librarian, school |
---|
14 | 14 | | counselor, or nurse until step 20 is reached. |
---|
15 | 15 | | (b) For each year of work experience required for |
---|
16 | 16 | | certification in a career or technological field, up to a maximum of |
---|
17 | 17 | | twofive years, a certified career or technology education teacher |
---|
18 | 18 | | is entitled to salary step credit as if the work experience were |
---|
19 | 19 | | teaching experience. |
---|
20 | 20 | | (c) The commissioner shall adopt rules for determining the |
---|
21 | 21 | | experience for which a teacher, librarian, school counselor, or |
---|
22 | 22 | | nurse is to be given credit in placing the teacher, librarian, |
---|
23 | 23 | | school counselor, or nurse on the minimum salary schedule. A |
---|
24 | 24 | | district shall credit the teacher, librarian, school counselor, or |
---|
25 | 25 | | nurse for each year of experience without regard to whether the |
---|
26 | 26 | | years are consecutive. |
---|
27 | 27 | | (d) As long as a teacher or librarian who received a career |
---|
28 | 28 | | ladder supplement is employed by the same school district, the |
---|
29 | 29 | | teacher or librarian is entitled to: |
---|
30 | 30 | | (1) placement on the minimum salary schedule at the |
---|
31 | 31 | | step above the step on which the teacher would otherwise be placed, |
---|
32 | 32 | | if the teacher or librarian received a career ladder supplement for |
---|
33 | 33 | | level two of the career ladder on August 31, 1993; or |
---|
34 | 34 | | (2) placement on the minimum salary schedule at the |
---|
35 | 35 | | step two steps above the step on which the teacher would otherwise |
---|
36 | 36 | | be placed, if the teacher or librarian received a career ladder |
---|
37 | 37 | | supplement for level three of the career ladder on August 31, 1993. |
---|
38 | 38 | | SECTION 2. Section 823.404, Government Code, is amended to |
---|
39 | 39 | | read as follows: |
---|
40 | 40 | | (a) An eligible member may establish equivalent membership |
---|
41 | 41 | | service credit for up to a maximum of fiveone or two years of work |
---|
42 | 42 | | experience for which the member is entitled to salary step credit |
---|
43 | 43 | | under Section 21.403(b), Education Code. |
---|
44 | 44 | | (b) A member is eligible to establish equivalent membership |
---|
45 | 45 | | service credit under this section if the member has at least five |
---|
46 | 46 | | years of membership service credit. |
---|
47 | 47 | | (c) A member may establish credit under this section by |
---|
48 | 48 | | depositing with the retirement system, for each year of service, |
---|
49 | 49 | | the actuarial present value, at the time of deposit, of the |
---|
50 | 50 | | additional standard retirement annuity benefits that would be |
---|
51 | 51 | | attributable to the conversion of the work experience into service |
---|
52 | 52 | | credit based on rates and tables recommended by the actuary and |
---|
53 | 53 | | adopted by the board of trustees. |
---|
54 | 54 | | (d) After a member makes the deposits required by this |
---|
55 | 55 | | section, the retirement system shall grant the member one year of |
---|
56 | 56 | | equivalent membership service credit for each year of service |
---|
57 | 57 | | approved. |
---|
58 | 58 | | SECTION 3. This Act applies beginning with the 2023-2024 |
---|
59 | 59 | | school year. |
---|
60 | 60 | | SECTION 4. This Act takes effect immediately if it receives |
---|
61 | 61 | | a vote of two-thirds of all the members elected to each house, as |
---|
62 | 62 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
63 | 63 | | Act does not receive the vote necessary for immediate effect, this |
---|
64 | 64 | | Act takes effect September 1, 2023. |
