55 AN ACT
66 relating to the salary step credit for a certified career and
77 technology education teacher.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 21.403, Education Code, is amended to
1010 read as follows:
1111 (a) A teacher, librarian, school counselor, or nurse shall
1212 advance one step on the minimum salary schedule under Section
1313 21.402 for each year of experience as a teacher, librarian, school
1414 counselor, or nurse until step 20 is reached.
1515 (b) For each year of work experience required for
1616 certification in a career or technological field, up to a maximum of
1717 twofive years, a certified career or technology education teacher
1818 is entitled to salary step credit as if the work experience were
1919 teaching experience.
2020 (c) The commissioner shall adopt rules for determining the
2121 experience for which a teacher, librarian, school counselor, or
2222 nurse is to be given credit in placing the teacher, librarian,
2323 school counselor, or nurse on the minimum salary schedule. A
2424 district shall credit the teacher, librarian, school counselor, or
2525 nurse for each year of experience without regard to whether the
2626 years are consecutive.
2727 (d) As long as a teacher or librarian who received a career
2828 ladder supplement is employed by the same school district, the
2929 teacher or librarian is entitled to:
3030 (1) placement on the minimum salary schedule at the
3131 step above the step on which the teacher would otherwise be placed,
3232 if the teacher or librarian received a career ladder supplement for
3333 level two of the career ladder on August 31, 1993; or
3434 (2) placement on the minimum salary schedule at the
3535 step two steps above the step on which the teacher would otherwise
3636 be placed, if the teacher or librarian received a career ladder
3737 supplement for level three of the career ladder on August 31, 1993.
3838 SECTION 2. Section 823.404, Government Code, is amended to
3939 read as follows:
4040 (a) An eligible member may establish equivalent membership
4141 service credit for up to a maximum of fiveone or two years of work
4242 experience for which the member is entitled to salary step credit
4343 under Section 21.403(b), Education Code.
4444 (b) A member is eligible to establish equivalent membership
4545 service credit under this section if the member has at least five
4646 years of membership service credit.
4747 (c) A member may establish credit under this section by
4848 depositing with the retirement system, for each year of service,
4949 the actuarial present value, at the time of deposit, of the
5050 additional standard retirement annuity benefits that would be
5151 attributable to the conversion of the work experience into service
5252 credit based on rates and tables recommended by the actuary and
5353 adopted by the board of trustees.
5454 (d) After a member makes the deposits required by this
5555 section, the retirement system shall grant the member one year of
5656 equivalent membership service credit for each year of service
5757 approved.
5858 SECTION 3. This Act applies beginning with the 2023-2024
5959 school year.
6060 SECTION 4. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2023.
