55 AN ACT
66 relating to the referral of certain proceedings to an associate
77 judge and requests for reimbursement of all or part of an associate
88 judge's or interpreter's salary.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54A.004, Government Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) The commissioners court of a county may submit a request
1313 to the Texas Judicial Council for reimbursement of all or part of
1414 the salary paid to an associate judge to whom judges in the county
1515 give preference when referring cases under Section 54A.006(a)(11)
1616 to be paid from money appropriated to the council for the purposes
1717 of border security. The council may adopt rules to implement this
1818 subsection.
1919 SECTION 2. Section 54A.006(a), Government Code, is amended
2020 to read as follows:
2121 (a) A judge may refer to an associate judge any matter
2222 arising out of a criminal case involving:
2323 (1) a negotiated plea of guilty or no contest before
2424 the court;
2525 (2) a bond forfeiture;
2626 (3) a pretrial motion;
2727 (4) a writ of habeas corpus;
2828 (5) an examining trial;
2929 (6) an occupational driver's license;
3030 (7) an appeal of an administrative driver's license
3131 revocation hearing;
3232 (8) a civil commitment matter under Subtitle C, Title
3333 7, Health and Safety Code;
3434 (9) setting, adjusting, or revoking bond;
3535 (10) the issuance of search warrants, including a
3636 search warrant under Article 18.02(a)(10), Code of Criminal
3737 Procedure, notwithstanding Article 18.01(c), Code of Criminal
3838 Procedure; [and]
3939 (11) alleged conduct constituting the offense of
4040 criminal trespass under Section 30.05, Penal Code, engaged in by a
4141 person not lawfully present in the United States; and
4242 (12) any other matter the judge considers necessary
4343 and proper.
4444 SECTION 3. Subchapter A, Chapter 57, Government Code, is
4545 amended by adding Section 57.003 to read as follows:
4646 Sec. 57.003. COMPENSATION. The commissioners court of a
4747 county may submit a request to the Texas Judicial Council for
4848 reimbursement of all or part of the salary paid to an interpreter
4949 for services rendered in a case referred under Section
5050 54A.006(a)(11) to be paid from money appropriated to the council
5151 for the purposes of border security. The council may adopt rules to
5252 implement this section.
5353 SECTION 4. This Act takes effect September 1, 2023.
