6 | 6 | | relating to the referral of certain proceedings to an associate |

7 | 7 | | judge and requests for reimbursement of all or part of an associate |
---|
8 | 8 | | judge's or interpreter's salary. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 54A.004, Government Code, is amended by |
---|
11 | 11 | | adding Subsection (d) to read as follows: |
---|
12 | 12 | | (d) The commissioners court of a county may submit a request |
---|
13 | 13 | | to the Texas Judicial Council for reimbursement of all or part of |
---|
14 | 14 | | the salary paid to an associate judge to whom judges in the county |
---|
15 | 15 | | give preference when referring cases under Section 54A.006(a)(11) |
---|
16 | 16 | | to be paid from money appropriated to the council for the purposes |
---|
17 | 17 | | of border security. The council may adopt rules to implement this |
---|
18 | 18 | | subsection. |
---|
19 | 19 | | SECTION 2. Section 54A.006(a), Government Code, is amended |
---|
20 | 20 | | to read as follows: |
---|
21 | 21 | | (a) A judge may refer to an associate judge any matter |
---|
22 | 22 | | arising out of a criminal case involving: |
---|
23 | 23 | | (1) a negotiated plea of guilty or no contest before |
---|
24 | 24 | | the court; |
---|
25 | 25 | | (2) a bond forfeiture; |
---|
26 | 26 | | (3) a pretrial motion; |
---|
27 | 27 | | (4) a writ of habeas corpus; |
---|
28 | 28 | | (5) an examining trial; |
---|
29 | 29 | | (6) an occupational driver's license; |
---|
30 | 30 | | (7) an appeal of an administrative driver's license |
---|
31 | 31 | | revocation hearing; |
---|
32 | 32 | | (8) a civil commitment matter under Subtitle C, Title |
---|
33 | 33 | | 7, Health and Safety Code; |
---|
34 | 34 | | (9) setting, adjusting, or revoking bond; |
---|
35 | 35 | | (10) the issuance of search warrants, including a |
---|
36 | 36 | | search warrant under Article 18.02(a)(10), Code of Criminal |
---|
37 | 37 | | Procedure, notwithstanding Article 18.01(c), Code of Criminal |
---|
38 | 38 | | Procedure; [and] |
---|
39 | 39 | | (11) alleged conduct constituting the offense of |
---|
40 | 40 | | criminal trespass under Section 30.05, Penal Code, engaged in by a |
---|
41 | 41 | | person not lawfully present in the United States; and |
---|
42 | 42 | | (12) any other matter the judge considers necessary |
---|
43 | 43 | | and proper. |
---|
44 | 44 | | SECTION 3. Subchapter A, Chapter 57, Government Code, is |
---|
45 | 45 | | amended by adding Section 57.003 to read as follows: |
---|
46 | 46 | | Sec. 57.003. COMPENSATION. The commissioners court of a |
---|
47 | 47 | | county may submit a request to the Texas Judicial Council for |
---|
48 | 48 | | reimbursement of all or part of the salary paid to an interpreter |
---|
49 | 49 | | for services rendered in a case referred under Section |
---|
50 | 50 | | 54A.006(a)(11) to be paid from money appropriated to the council |
---|
51 | 51 | | for the purposes of border security. The council may adopt rules to |
---|
52 | 52 | | implement this section. |
---|
53 | 53 | | SECTION 4. This Act takes effect September 1, 2023. |
---|
