66 AN ACT
77 relating to certain disclosures and other requirements relating to
88 the sale of concert and other event tickets.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 6, Business & Commerce Code, is amended by
1111 adding Chapter 205 to read as follows:
1212 CHAPTER 205. SALE OF EVENT TICKETS
1313 Sec. 205.001. DEFINITIONS. In this chapter:
1414 (1) "Ancillary fee" includes a service charge,
1515 surcharge, or any other fee charged in connection with the sale of
1616 an event ticket. The term does not include a shipping fee or any
1717 applicable local, state, or federal taxes.
1818 (2) "Event" means a concert, theatrical performance,
1919 sporting event, exhibition, show, or similar scheduled activity
2020 that:
2121 (A) is open to the public;
2222 (B) is held in a public or private venue; and
2323 (C) requires payment of an admission fee to
2424 attend the activity.
2525 (3) "Ticket seller" means a person that sells or
2626 resells tickets for a concert or other event, including the
2727 operator of a ticket website or the operator's agent.
2828 (4) "Ticket website" means an Internet website or
2929 mobile application advertising or offering the sale of tickets, or
3030 offering tickets for resale, to an event in this state.
3131 (5) "Venue" means an arena, stadium, theater, concert
3232 hall, or other place used for events.
3333 Sec. 205.002. APPLICABILITY. (a) This chapter applies
3434 only to the sale or resale of a ticket for a concert or other event
3535 that will be held in this state.
3636 (b) Notwithstanding Subsection (a), this chapter does not
3737 apply to the sale or resale of a ticket by a movie theater, unless
3838 the movie theater is hosting a live event.
3939 Sec. 205.003. DISCLOSURE OF ANCILLARY FEES. A ticket
4040 seller offering tickets for sale or resale on a ticket website shall
4141 disclose in a clear and conspicuous manner to a potential ticket
4242 purchaser in the ticket listing and before the purchaser selects
4343 the ticket for purchase:
4444 (1) the total cost, stated in dollars, of the ticket
4545 purchase, including all ancillary fees the purchaser must pay to
4646 complete the purchase; and
4747 (2) the portion of the total cost, stated in dollars,
4848 of the ticket purchase that is represented by ancillary fees.
4949 Sec. 205.004. PROHIBITED CONDUCT. A ticket seller may not:
5050 (1) disclose a fee in a manner that is false or
5151 misleading;
5252 (2) display an ancillary fee or any component of the
5353 total price of a ticket purchase more prominently or in the same
5454 font as or a larger font than the total price of the ticket
5555 purchase; or
5656 (3) increase the total cost of a ticket purchase
5757 during the purchase process after a potential ticket purchaser has
5858 selected a ticket for purchase, except to charge a reasonable fee
5959 disclosed before the final purchase of the ticket for the delivery
6060 of the ticket by a nonelectronic delivery method selected by the
6161 purchaser.
6262 Sec. 205.005. OTHER LAWS NOT AFFECTED. This chapter may not
6363 be construed to nullify, expand, or otherwise affect any other law
6464 regarding the sale of a ticket for a concert or other event.
6565 SECTION 2. This Act takes effect September 1, 2023.
