8 | 8 | | operations by The University of Texas Bureau of Economic Geology. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter E, Chapter 67, Education Code, is |
---|
11 | 11 | | amended by adding Section 67.73 to read as follows: |
---|
12 | 12 | | Sec. 67.73. IDENTIFICATION AND MAPPING OF AGGREGATE |
---|
13 | 13 | | PRODUCTION OPERATIONS. (a) In this section, "aggregate production |
---|
14 | 14 | | operation" has the meaning assigned by Section 28A.001, Water Code. |
---|
15 | 15 | | (b) The bureau shall: |
---|
16 | 16 | | (1) conduct a study to identify: |
---|
17 | 17 | | (A) locations in this state suitable for |
---|
18 | 18 | | aggregate production operations; and |
---|
19 | 19 | | (B) existing land uses or planning policies of |
---|
20 | 20 | | political subdivisions that could result in a location identified |
---|
21 | 21 | | under Paragraph (A) becoming incompatible with use as an aggregate |
---|
22 | 22 | | production operation; |
---|
23 | 23 | | (2) develop and maintain a database that: |
---|
24 | 24 | | (A) maps locations identified under Subdivision |
---|
25 | 25 | | (1)(A) and Section 28A.052, Water Code; and |
---|
26 | 26 | | (B) is accessible to political subdivisions; and |
---|
27 | 27 | | (3) update the study and map described by Subdivisions |
---|
28 | 28 | | (1) and (2) not less than once every 10 years. |
---|
29 | 29 | | (c) In fulfilling the duties described by Subsection (b), |
---|
30 | 30 | | the bureau may cooperate with: |
---|
31 | 31 | | (1) the Texas Commission on Environmental Quality, the |
---|
32 | 32 | | Texas Water Development Board, and any other state agency, |
---|
33 | 33 | | political subdivision, or university with access to information |
---|
34 | 34 | | related to aggregate production operations; and |
---|
35 | 35 | | (2) federal agencies or private entities as |
---|
36 | 36 | | appropriate to fulfill the requirements of this section. |
---|
37 | 37 | | (d) An agency, political subdivision, or university |
---|
38 | 38 | | described by Subsection (c)(1) shall provide to the bureau on |
---|
39 | 39 | | request available information as necessary to fulfill the |
---|
40 | 40 | | requirements of this section. |
---|
41 | 41 | | SECTION 2. Not later than December 1, 2025, The University |
---|
42 | 42 | | of Texas Bureau of Economic Geology shall submit to the legislature |
---|
43 | 43 | | a report that contains: |
---|
44 | 44 | | (1) a summary of the study conducted under Section |
---|
45 | 45 | | 67.73, Education Code, as added by this Act; |
---|
46 | 46 | | (2) a map containing the locations of aggregate |
---|
47 | 47 | | production operations identified by Section 67.73, Education Code, |
---|
48 | 48 | | as added by this Act; and |
---|
49 | 49 | | (3) any recommendations for legislative action |
---|
50 | 50 | | necessary to facilitate, if appropriate, the preservation for |
---|
51 | 51 | | aggregate production operations the locations identified by |
---|
52 | 52 | | Section 67.73, Education Code, as added by this Act, including any |
---|
53 | 53 | | recommendations regarding existing land use or planning policies of |
---|
54 | 54 | | political subdivisions. |
---|
55 | 55 | | SECTION 3. This Act takes effect September 1, 2023. |
