55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the identification and mapping of aggregate production
88 operations by The University of Texas Bureau of Economic Geology.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 67, Education Code, is
1111 amended by adding Section 67.73 to read as follows:
1212 Sec. 67.73. IDENTIFICATION AND MAPPING OF AGGREGATE
1313 PRODUCTION OPERATIONS. (a) In this section, "aggregate production
1414 operation" has the meaning assigned by Section 28A.001, Water Code.
1515 (b) The bureau shall:
1616 (1) conduct a study to identify:
1717 (A) locations in this state suitable for
1818 aggregate production operations; and
1919 (B) existing land uses or planning policies of
2020 political subdivisions that could result in a location identified
2121 under Paragraph (A) becoming incompatible with use as an aggregate
2222 production operation;
2323 (2) develop and maintain a database that:
2424 (A) maps locations identified under Subdivision
2525 (1)(A) and Section 28A.052, Water Code; and
2626 (B) is accessible to political subdivisions; and
2727 (3) update the study and map described by Subdivisions
2828 (1) and (2) not less than once every 10 years.
2929 (c) In fulfilling the duties described by Subsection (b),
3030 the bureau may cooperate with:
3131 (1) the Texas Commission on Environmental Quality, the
3232 Texas Water Development Board, and any other state agency,
3333 political subdivision, or university with access to information
3434 related to aggregate production operations; and
3535 (2) federal agencies or private entities as
3636 appropriate to fulfill the requirements of this section.
3737 (d) An agency, political subdivision, or university
3838 described by Subsection (c)(1) shall provide to the bureau on
3939 request available information as necessary to fulfill the
4040 requirements of this section.
4141 SECTION 2. Not later than December 1, 2025, The University
4242 of Texas Bureau of Economic Geology shall submit to the legislature
4343 a report that contains:
4444 (1) a summary of the study conducted under Section
4545 67.73, Education Code, as added by this Act;
4646 (2) a map containing the locations of aggregate
4747 production operations identified by Section 67.73, Education Code,
4848 as added by this Act; and
4949 (3) any recommendations for legislative action
5050 necessary to facilitate, if appropriate, the preservation for
5151 aggregate production operations the locations identified by
5252 Section 67.73, Education Code, as added by this Act, including any
5353 recommendations regarding existing land use or planning policies of
5454 political subdivisions.
5555 SECTION 3. This Act takes effect September 1, 2023.
