55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the methods to achieve a college, career, or military
88 outcomes bonus under the Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.110, Education Code, is amended by
1111 amending Subsections (f) and (h) and adding Subsection (j) to read
1212 as follows:
1313 (f) For purposes of this section, an annual graduate
1414 demonstrates:
1515 (1) college readiness if the annual graduate:
1616 (A) both:
1717 (i) achieves college readiness standards
1818 used for accountability purposes under Chapter 39 on the ACT, the
1919 SAT, or an assessment instrument designated by the Texas Higher
2020 Education Coordinating Board under Section 51.334; and
2121 (ii) not later than one year after
2222 graduation from high school, earns a minimum of 12 non-remedial
2323 semester credit hours [during a time period established by
2424 commissioner rule, enrolls] at a postsecondary educational
2525 institution; or
2626 (B) earns an associate degree from a
2727 postsecondary educational institution approved by the Texas Higher
2828 Education Coordinating Board while attending high school or during
2929 a time period established by commissioner rule;
3030 (2) career readiness if the annual graduate:
3131 (A) achieves college readiness standards used
3232 for accountability purposes under Chapter 39 on the ACT, the SAT, or
3333 an assessment instrument designated by the Texas Higher Education
3434 Coordinating Board under Section 51.334; and
3535 (B) not later than one year after graduation from
3636 high school:
3737 (i) [during a time period established by
3838 commissioner rule,] earns a credential of value as defined by Texas
3939 Higher Education Coordinating Board rule or included in a library
4040 of credentials established under Section 2308A.007, Government
4141 Code;
4242 (ii) is employed at or above a salary level
4343 equal to 100 percent of the median wage of jobs in the graduate's
4444 region, as determined by the commissioner using the most recent
4545 information available from sources the commissioner considers
4646 reliable, including the Texas Workforce Commission, the
4747 comptroller, and the United States Bureau of Labor Statistics; or
4848 (iii) is enrolled in or has completed an
4949 apprenticeship program recognized or approved by the Office of
5050 Apprenticeship of the United States Department of Labor or an
5151 industry-recognized apprenticeship approved or certified by the
5252 Texas Workforce Commission [an industry-accepted certificate]; and
5353 (3) military readiness if the annual graduate:
5454 (A) achieves a passing score set by the
5555 applicable military branch on the Armed Services Vocational
5656 Aptitude Battery; and
5757 (B) during a time period established by
5858 commissioner rule, enlists in the armed forces of the United States
5959 or the Texas National Guard.
6060 (h) On application by a school district, the commissioner
6161 may allow annual graduates from the district to satisfy the
6262 requirement for demonstrating career readiness under Subsection
6363 (f)(2)(B)(i) [(f)(2)(B)] by successfully completing a coherent
6464 sequence of courses required to obtain a credential of value as
6565 described by that subparagraph [an industry-accepted certificate].
6666 The district must demonstrate in the application that neither the
6767 district nor a postsecondary institution located within 30 miles of
6868 a student's campus is able [unable] to provide sufficient courses
6969 or programs to enable students enrolled at the district to actually
7070 earn a credential of value [an industry-accepted certificate]
7171 within the time period established [by the commissioner] under
7272 Subsection (f)(2)(B). The commissioner by rule shall provide the
7373 criteria required for an application under this subsection.
7474 (j) The commissioner shall adopt rules permitting a school
7575 district to award to an annual graduate who voluntarily reports
7676 information described by Subsection (f) to the district a portion
7777 of the outcomes bonus to which the district is entitled for an
7878 annual graduate under this section.
7979 SECTION 2. This Act applies beginning with the 2023-2024
8080 school year.
8181 SECTION 3. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2023.
