| 7 | 7 | | relating to the acceptable uses of the instructional materials and |

| 8 | 8 | | technology fund and the review of certain instructional materials |
|---|
| 9 | 9 | | by the State Board of Education. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 31.021(c), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (c) Money in the state instructional materials and |
|---|
| 14 | 14 | | technology fund shall be used to: |
|---|
| 15 | 15 | | (1) fund the instructional materials and technology |
|---|
| 16 | 16 | | allotment, as provided by Section 31.0211; |
|---|
| 17 | 17 | | (2) purchase special instructional materials for the |
|---|
| 18 | 18 | | education of blind and visually impaired students in public |
|---|
| 19 | 19 | | schools; |
|---|
| 20 | 20 | | (3) pay the expenses associated with the instructional |
|---|
| 21 | 21 | | materials adoption and review process under this chapter; |
|---|
| 22 | 22 | | (4) pay the expenses associated with the purchase or |
|---|
| 23 | 23 | | licensing of open education resource instructional material; |
|---|
| 24 | 24 | | (5) pay the expenses associated with the purchase of |
|---|
| 25 | 25 | | instructional material, including freight and shipping and the |
|---|
| 26 | 26 | | insurance expenses associated with freight and shipping; |
|---|
| 27 | 27 | | (6) fund the technology lending grant program |
|---|
| 28 | 28 | | established under Section 32.301; |
|---|
| 29 | 29 | | (7) provide funding to the Texas School for the Blind |
|---|
| 30 | 30 | | and Visually Impaired, the Texas School for the Deaf, and the Texas |
|---|
| 31 | 31 | | Juvenile Justice Department; [and] |
|---|
| 32 | 32 | | (8) pay the expenses associated with the instructional |
|---|
| 33 | 33 | | materials web portal developed under Section 31.081; and |
|---|
| 34 | 34 | | (9) pay the expenses associated with the review of |
|---|
| 35 | 35 | | instructional materials under Section 31.0222. |
|---|
| 36 | 36 | | SECTION 2. Subchapter B, Chapter 31, Education Code, is |
|---|
| 37 | 37 | | amended by adding Section 31.0222 to read as follows: |
|---|
| 38 | 38 | | Sec. 31.0222. REVIEW OF INSTRUCTIONAL MATERIAL NOT |
|---|
| 39 | 39 | | SUBMITTED BY PUBLISHER. (a) At any time, the State Board of |
|---|
| 40 | 40 | | Education may review an instructional material not submitted by a |
|---|
| 41 | 41 | | publisher. A review under this section does not require a board |
|---|
| 42 | 42 | | proclamation. |
|---|
| 43 | 43 | | (b) A review under this section must: |
|---|
| 44 | 44 | | (1) include a determination of the percentage of the |
|---|
| 45 | 45 | | elements of the essential knowledge and skills of the subject and |
|---|
| 46 | 46 | | grade level covered for the instructional material as provided |
|---|
| 47 | 47 | | under Section 31.023(a-1); and |
|---|
| 48 | 48 | | (2) be made available to school districts and the |
|---|
| 49 | 49 | | public. |
|---|
| 50 | 50 | | SECTION 3. This Act takes effect September 1, 2023. |
