55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the acceptable uses of the instructional materials and
88 technology fund and the review of certain instructional materials
99 by the State Board of Education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 31.021(c), Education Code, is amended to
1212 read as follows:
1313 (c) Money in the state instructional materials and
1414 technology fund shall be used to:
1515 (1) fund the instructional materials and technology
1616 allotment, as provided by Section 31.0211;
1717 (2) purchase special instructional materials for the
1818 education of blind and visually impaired students in public
1919 schools;
2020 (3) pay the expenses associated with the instructional
2121 materials adoption and review process under this chapter;
2222 (4) pay the expenses associated with the purchase or
2323 licensing of open education resource instructional material;
2424 (5) pay the expenses associated with the purchase of
2525 instructional material, including freight and shipping and the
2626 insurance expenses associated with freight and shipping;
2727 (6) fund the technology lending grant program
2828 established under Section 32.301;
2929 (7) provide funding to the Texas School for the Blind
3030 and Visually Impaired, the Texas School for the Deaf, and the Texas
3131 Juvenile Justice Department; [and]
3232 (8) pay the expenses associated with the instructional
3333 materials web portal developed under Section 31.081; and
3434 (9) pay the expenses associated with the review of
3535 instructional materials under Section 31.0222.
3636 SECTION 2. Subchapter B, Chapter 31, Education Code, is
3737 amended by adding Section 31.0222 to read as follows:
3838 Sec. 31.0222. REVIEW OF INSTRUCTIONAL MATERIAL NOT
3939 SUBMITTED BY PUBLISHER. (a) At any time, the State Board of
4040 Education may review an instructional material not submitted by a
4141 publisher. A review under this section does not require a board
4242 proclamation.
4343 (b) A review under this section must:
4444 (1) include a determination of the percentage of the
4545 elements of the essential knowledge and skills of the subject and
4646 grade level covered for the instructional material as provided
4747 under Section 31.023(a-1); and
4848 (2) be made available to school districts and the
4949 public.
5050 SECTION 3. This Act takes effect September 1, 2023.
