| 6 | 6 | | relating to investigations and security provided by former members |

| 7 | 7 | | of the special forces. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 1702.101 and 1702.102, Occupation Code, |
|---|
| 10 | 10 | | are amended to read as follows: |
|---|
| 11 | 11 | | Sec. 1702.101. INVESTIGATIONS COMPANY LICENSE REQUIRED. |
|---|
| 12 | 12 | | (a) Unless the person holds a license as an investigations company, |
|---|
| 13 | 13 | | a person may not: |
|---|
| 14 | 14 | | (1) act as an investigations company; |
|---|
| 15 | 15 | | (2) offer to perform the services of an investigations |
|---|
| 16 | 16 | | company; or |
|---|
| 17 | 17 | | (3) engage in business activity for which a license is |
|---|
| 18 | 18 | | required under this chapter. |
|---|
| 19 | 19 | | (b) Subsection (a) does not apply to a person who has served |
|---|
| 20 | 20 | | in the special forces as defined by Section 1701.315(a), and is |
|---|
| 21 | 21 | | conducting counter human-trafficking operations. |
|---|
| 22 | 22 | | Sec. 1702.102. SECURITY SERVICES CONTRACTOR LICENSE |
|---|
| 23 | 23 | | REQUIRED; SCOPE OF LICENSE. (a) Unless the person holds a license |
|---|
| 24 | 24 | | as a security services contractor, a person may not: |
|---|
| 25 | 25 | | (1) act as an alarm systems company, armored car |
|---|
| 26 | 26 | | company, courier company, guard company, or locksmith company; |
|---|
| 27 | 27 | | (2) offer to perform the services of a company in |
|---|
| 28 | 28 | | Subdivision (1); or |
|---|
| 29 | 29 | | (3) engage in business activity for which a license is |
|---|
| 30 | 30 | | required under this chapter. |
|---|
| 31 | 31 | | (b) A person licensed only as a security services contractor |
|---|
| 32 | 32 | | may not conduct an investigation other than an investigation |
|---|
| 33 | 33 | | incidental to the loss, misappropriation, or concealment of |
|---|
| 34 | 34 | | property that the person has been engaged to protect. |
|---|
| 35 | 35 | | (c) Subsection (a) does not apply to a person who has served |
|---|
| 36 | 36 | | in the special forces as defined by Section 1701.315(a), and is |
|---|
| 37 | 37 | | conducting counter human-trafficking operations. |
|---|
| 38 | 38 | | SECTION 2. Section 46.15, Penal Code, is amended by adding |
|---|
| 39 | 39 | | Subsection 46.15(a)(11) to read as follows: |
|---|
| 40 | 40 | | (11) a person who has served in the special forces as |
|---|
| 41 | 41 | | defined by Section 1701.315(a), Occupations Code, and is conducting |
|---|
| 42 | 42 | | counter human-trafficking operations. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect on September 1, 2023. |
