55 AN ACT
66 relating to investigations and security provided by former members

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 1702.101 and 1702.102, Occupation Code,
1010 are amended to read as follows:
1111 Sec. 1702.101. INVESTIGATIONS COMPANY LICENSE REQUIRED.
1212 (a) Unless the person holds a license as an investigations company,
1313 a person may not:
1414 (1) act as an investigations company;
1515 (2) offer to perform the services of an investigations
1616 company; or
1717 (3) engage in business activity for which a license is
1818 required under this chapter.
1919 (b) Subsection (a) does not apply to a person who has served
2020 in the special forces as defined by Section 1701.315(a), and is
2121 conducting counter human-trafficking operations.
2222 Sec. 1702.102. SECURITY SERVICES CONTRACTOR LICENSE
2323 REQUIRED; SCOPE OF LICENSE. (a) Unless the person holds a license
2424 as a security services contractor, a person may not:
2525 (1) act as an alarm systems company, armored car
2626 company, courier company, guard company, or locksmith company;
2727 (2) offer to perform the services of a company in
2828 Subdivision (1); or
2929 (3) engage in business activity for which a license is
3030 required under this chapter.
3131 (b) A person licensed only as a security services contractor
3232 may not conduct an investigation other than an investigation
3333 incidental to the loss, misappropriation, or concealment of
3434 property that the person has been engaged to protect.
3535 (c) Subsection (a) does not apply to a person who has served
3636 in the special forces as defined by Section 1701.315(a), and is
3737 conducting counter human-trafficking operations.
3838 SECTION 2. Section 46.15, Penal Code, is amended by adding
3939 Subsection 46.15(a)(11) to read as follows:
4040 (11) a person who has served in the special forces as
4141 defined by Section 1701.315(a), Occupations Code, and is conducting
4242 counter human-trafficking operations.
4343 SECTION 3. This Act takes effect on September 1, 2023.
