| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter B, Chapter 545, Transportation Code, |
|---|
| 9 | 9 | | is amended by adding Section 545.0605 to read as follows: |
|---|
| 10 | 10 | | Sec. 545.0605. OPERATION OF MOTORCYCLES ON ROADWAY LANED |
|---|
| 11 | 11 | | FOR TRAFFIC. (a) The operator of a motorcycle: |
|---|
| 12 | 12 | | (1) is entitled to full use of a lane and, except as |
|---|
| 13 | 13 | | otherwise provided by Subdivision (2), a motor vehicle may not be |
|---|
| 14 | 14 | | driven in a manner that deprives a motorcycle of the full use of a |
|---|
| 15 | 15 | | lane; |
|---|
| 16 | 16 | | (2) may operate the motorcycle two abreast in a single |
|---|
| 17 | 17 | | lane with another motorcycle; and |
|---|
| 18 | 18 | | (3) may not; |
|---|
| 19 | 19 | | (A) operate the motorcycle more than two abreast |
|---|
| 20 | 20 | | in a single lane with other motorcycles; |
|---|
| 21 | 21 | | (B) operate the motorcycle between lanes of |
|---|
| 22 | 22 | | traffic moving in the same direction; or |
|---|
| 23 | 23 | | (C) pass a motor vehicle while in the same lane as |
|---|
| 24 | 24 | | the vehicle being passed. |
|---|
| 25 | 25 | | (b) Subsection (a)(3) does not apply to a police officer in |
|---|
| 26 | 26 | | the performance of the officer's official duties. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
