| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 264, Family Code, is |
|---|
| 12 | 12 | | amended by adding Section 264.131 to read as follows: |
|---|
| 13 | 13 | | Sec. 264.131. DONATION OF FOSTER CARE PAYMENTS. (a) The |
|---|
| 14 | 14 | | department shall adopt a policy to allow a foster parent to donate |
|---|
| 15 | 15 | | to the department a payment made under Section 264.101. |
|---|
| 16 | 16 | | (b) The department may use a donation authorized under this |
|---|
| 17 | 17 | | section: |
|---|
| 18 | 18 | | (1) in accordance with Section 264.101(e); |
|---|
| 19 | 19 | | (2) to provide adoption assistance under Chapter 162; |
|---|
| 20 | 20 | | or |
|---|
| 21 | 21 | | (3) to provide any other assistance for a foster child |
|---|
| 22 | 22 | | authorized by Title 5. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
