| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 61, Property Code, is amended by adding |

| 9 | 9 | | Section 61.006 to read as follows: |
|---|
| 10 | 10 | | Sec. 61.006. ATTORNEY'S FEES. The prevailing party in an |

| 11 | 11 | | action to enforce this chapter is entitled to recover reasonable |
|---|
| 12 | 12 | | attorney's fees. |
|---|
| 13 | 13 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 14 | 14 | | to an action commenced on or after the effective date of this Act. |
|---|
| 15 | 15 | | SECTION 3. This Act takes effect September 1, 2023. |
