66 AN ACT
77 relating to the eligibility of certain first responders for
88 workers' compensation benefits for post-traumatic stress disorder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 501, Labor Code, is
1111 amended by adding Section 501.027 to read as follows:
1212 Sec. 501.027. COVERAGE FOR POST-TRAUMATIC STRESS DISORDER
1313 FOR FIRST RESPONDERS. (a) In this section:
1414 (1) "First responder" means:
1515 (A) an employee described by Section
1616 501.001(5)(C), (D), (E), or (F); or
1717 (B) an employee who is:
1818 (i) a person licensed under Chapter 773,
1919 Health and Safety Code, as an emergency care attendant, emergency
2020 medical technician, emergency medical technician-intermediate,
2121 emergency medical technician-paramedic, or licensed paramedic; or
2222 (ii) a firefighter subject to certification
2323 by the Texas Commission on Fire Protection under Chapter 419,
2424 Government Code, whose principal duties are firefighting and
2525 aircraft crash and rescue.
2626 (2) "Post-traumatic stress disorder" means a disorder
2727 that meets the diagnostic criteria for post-traumatic stress
2828 disorder specified by the American Psychiatric Association in the
2929 Diagnostic and Statistical Manual of Mental Disorders, fifth
3030 edition, or a later edition adopted by the commissioner of workers'
3131 compensation.
3232 (b) Post-traumatic stress disorder suffered by a first
3333 responder is a compensable injury under this subtitle only if it is
3434 based on a diagnosis that:
3535 (1) the disorder is caused by one or more events
3636 occurring in the course and scope of the first responder's
3737 employment; and
3838 (2) the preponderance of the evidence indicates that
3939 the event or events were a producing cause of the disorder.
4040 (c) For purposes of this subtitle, the date of injury for
4141 post-traumatic stress disorder suffered by a first responder is the
4242 date on which the first responder first knew or should have known
4343 that the disorder may be related to the first responder's
4444 employment.
4545 SECTION 2. Subchapter B, Chapter 502, Labor Code, is
4646 amended by adding Section 502.026 to read as follows:
4747 Sec. 502.026. COVERAGE FOR POST-TRAUMATIC STRESS DISORDER
4848 FOR FIRST RESPONDERS. (a) In this section:
4949 (1) "First responder" means an employee who is:
5050 (A) a peace officer under Article 2.12, Code of
5151 Criminal Procedure;
5252 (B) a person licensed under Chapter 773, Health
5353 and Safety Code, as an emergency care attendant, emergency medical
5454 technician, emergency medical technician-intermediate, emergency
5555 medical technician-paramedic, or licensed paramedic; or
5656 (C) a firefighter subject to certification by the
5757 Texas Commission on Fire Protection under Chapter 419, Government
5858 Code, whose principal duties are firefighting and aircraft crash
5959 and rescue.
6060 (2) "Post-traumatic stress disorder" means a disorder
6161 that meets the diagnostic criteria for post-traumatic stress
6262 disorder specified by the American Psychiatric Association in the
6363 Diagnostic and Statistical Manual of Mental Disorders, fifth
6464 edition, or a later edition adopted by the commissioner of workers'
6565 compensation.
6666 (b) Post-traumatic stress disorder suffered by a first
6767 responder is a compensable injury under this subtitle only if it is
6868 based on a diagnosis that:
6969 (1) the disorder is caused by one or more events
7070 occurring in the course and scope of the first responder's
7171 employment; and
7272 (2) the preponderance of the evidence indicates that
7373 the event or events were a producing cause of the disorder.
7474 (c) For purposes of this subtitle, the date of injury for
7575 post-traumatic stress disorder suffered by a first responder is the
7676 date on which the first responder first knew or should have known
7777 that the disorder may be related to the first responder's
7878 employment.
7979 SECTION 3. Subchapter B, Chapter 503, Labor Code, is
8080 amended by adding Section 503.026 to read as follows:
8181 Sec. 503.026. COVERAGE FOR POST-TRAUMATIC STRESS DISORDER
8282 FOR FIRST RESPONDERS. (a) In this section:
8383 (1) "First responder" means an employee who is:
8484 (A) a peace officer under Article 2.12, Code of
8585 Criminal Procedure;
8686 (B) a person licensed under Chapter 773, Health
8787 and Safety Code, as an emergency care attendant, emergency medical
8888 technician, emergency medical technician-intermediate, emergency
8989 medical technician-paramedic, or licensed paramedic; or
9090 (C) a firefighter subject to certification by the
9191 Texas Commission on Fire Protection under Chapter 419, Government
9292 Code, whose principal duties are firefighting and aircraft crash
9393 and rescue.
9494 (2) "Post-traumatic stress disorder" means a disorder
9595 that meets the diagnostic criteria for post-traumatic stress
9696 disorder specified by the American Psychiatric Association in the
9797 Diagnostic and Statistical Manual of Mental Disorders, fifth
9898 edition, or a later edition adopted by the commissioner of workers'
9999 compensation.
100100 (b) Post-traumatic stress disorder suffered by a first
101101 responder is a compensable injury under this subtitle only if it is
102102 based on a diagnosis that:
103103 (1) the disorder is caused by one or more events
104104 occurring in the course and scope of the first responder's
105105 employment; and
106106 (2) the preponderance of the evidence indicates that
107107 the event or events were a producing cause of the disorder.
108108 (c) For purposes of this subtitle, the date of injury for
109109 post-traumatic stress disorder suffered by a first responder is the
110110 date on which the first responder first knew or should have known
111111 that the disorder may be related to the first responder's
112112 employment.
113113 SECTION 4. Subchapter B, Chapter 505, Labor Code, is
114114 amended by adding Section 505.014 to read as follows:
115115 Sec. 505.014. COVERAGE FOR POST-TRAUMATIC STRESS DISORDER
116116 FOR FIRST RESPONDERS. (a) In this section:
117117 (1) "First responder" means an employee who is:
118118 (A) a peace officer under Article 2.12, Code of
119119 Criminal Procedure;
120120 (B) a person licensed under Chapter 773, Health
121121 and Safety Code, as an emergency care attendant, emergency medical
122122 technician, emergency medical technician-intermediate, emergency
123123 medical technician-paramedic, or licensed paramedic; or
124124 (C) a firefighter subject to certification by the
125125 Texas Commission on Fire Protection under Chapter 419, Government
126126 Code, whose principal duties are firefighting and aircraft crash
127127 and rescue.
128128 (2) "Post-traumatic stress disorder" means a disorder
129129 that meets the diagnostic criteria for post-traumatic stress

134134 (b) Post-traumatic stress disorder suffered by a first
135135 responder is a compensable injury under this subtitle only if it is
136136 based on a diagnosis that:
137137 (1) the disorder is caused by one or more events
138138 occurring in the course and scope of the first responder's
139139 employment; and
140140 (2) the preponderance of the evidence indicates that
141141 the event or events were a producing cause of the disorder.
142142 (c) For purposes of this subtitle, the date of injury for
143143 post-traumatic stress disorder suffered by a first responder is the
144144 date on which the first responder first knew or should have known
145145 that the disorder may be related to the first responder's
146146 employment.
147147 SECTION 5. Section 408.006(b), Labor Code, is amended to
148148 read as follows:
149149 (b) Notwithstanding Sections 501.027, 502.026, 503.026,
150150 [Section] 504.019, and 505.014, a mental or emotional injury that
151151 arises principally from a legitimate personnel action, including a
152152 transfer, promotion, demotion, or termination, is not a compensable
153153 injury under this subtitle.
154154 SECTION 6. The changes in law made by this Act apply only to
155155 a claim for workers' compensation benefits based on a compensable
156156 injury that occurs on or after the effective date of this Act. A
157157 claim based on a compensable injury that occurs before that date is
158158 governed by the law as it existed on the date the compensable injury
159159 occurred, and the former law is continued in effect for that
160160 purpose.
161161 SECTION 7. This Act takes effect September 1, 2023.
