| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Section 162.015, Election Code, |

| 10 | 10 | | is amended to read as follows: |

| 11 | 11 | | Sec. 162.015. RESTRICTIONS ON CANDIDACY IN GENERAL ELECTION |

| 12 | 12 | | [BY CANDIDATE OR VOTER IN PRIMARY]. |

| 13 | 13 | | SECTION 2. Section 162.015, Election Code, is amended by |

| 14 | 14 | | adding Subsection (c) to read as follows: |

| 15 | 15 | | (c) A person who was considered for nomination as a |
|---|
| 16 | 16 | | replacement candidate under Section 145.036 but did not receive a |
|---|
| 17 | 17 | | favorable vote of a majority of the voting members of the state, |
|---|
| 18 | 18 | | district, county, or precinct executive committee, as appropriate |
|---|
| 19 | 19 | | for the particular office, is ineligible for a place on the list of |
|---|
| 20 | 20 | | write-in candidates for the succeeding general election for state |
|---|
| 21 | 21 | | and county officers as a write-in candidate for the office sought by |
|---|
| 22 | 22 | | that candidate. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
