77 relating to the procedure for closing a polling place.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 61.002, Election Code, is amended by
1010 adding Subsection (e) to read as follows:
1111 (e) Except as provided by Section 41.032, the presiding
1212 election judge or alternate election judge may not order the polls
1313 to stay open past the official closing time.
1414 SECTION 2. Chapter 273, Election Code, is amended by adding
1515 Subchapter F to read as follows:
1616 SUBCHAPTER F. OTHER ENFORCEMENT PROCEEDINGS
1717 Sec. 273.101. PROHIBITED ORDER. Notwithstanding any other
1818 law or rule, a district judge, county court at law judge, or
1919 statutory county court judge may not issue an order that has the
2020 effect of extending the hours that polls are required to remain open
2121 under Section 41.031 at any polling place.
2222 SECTION 3. This Act takes effect September 1, 2023.
