| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 11.060(a) and (c), Education Code, are |

| 11 | 11 | | amended to read as follows: |

| 12 | 12 | | (a) If a vacancy occurs on the board of trustees of an |
|---|
| 13 | 13 | | independent school district, the board or municipal governing body |
|---|
| 14 | 14 | | shall order a special election to fill the vacancy [remaining |
|---|
| 15 | 15 | | trustees may fill the vacancy by appointment until the next trustee |
|---|
| 16 | 16 | | election]. |
|---|
| 17 | 17 | | (c) [Instead of filling a vacancy by appointment under |
|---|
| 18 | 18 | | Subsection (a) or (b), the board or municipal governing body may |
|---|
| 19 | 19 | | order a special election to fill the vacancy.] A special election |
|---|
| 20 | 20 | | is conducted in the same manner as the district's general election |
|---|
| 21 | 21 | | except as provided by the Election Code. |

| 22 | 22 | | SECTION 2. Section 11.060(b), Education Code, is repealed. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
