66 AN ACT
77 relating to strategies to increase the availability of child-care
88 and prekindergarten programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 302, Labor Code, is
1111 amended by adding Sections 302.0051 and 302.0063 to read as
1212 follows:
1313 Sec. 302.0051. PREKINDERGARTEN PARTNERSHIP PROGRAM. (a)
1414 The commission shall establish and administer a prekindergarten
1515 partnership program to assist Texas Rising Star program providers
1616 who meet the definition of an eligible private provider under
1717 Section 29.171, Education Code, in partnering with local school
1818 districts and open-enrollment charter schools to provide the
1919 prekindergarten classes required under Section 29.153, Education
2020 Code.
2121 (b) Using existing funds, the commission shall coordinate
2222 with the Texas Education Agency to develop joint strategies to
2323 expand the availability of prekindergarten partnership programs,
2424 including by:
2525 (1) establishing and maintaining a database of Texas
2626 Rising Star program providers within the boundaries of each school
2727 district and open-enrollment charter school;
2828 (2) assisting in negotiating and administering
2929 contracts between school districts or open-enrollment charter
3030 schools, as applicable, and Texas Rising Star program providers to
3131 provide prekindergarten classes; and
3232 (3) annually establishing guidelines for funding
3333 amounts per child to be provided by a school district or
3434 open-enrollment charter school, as applicable, to a Texas Rising
3535 Star program provider with which the district or charter school
3636 partners to provide prekindergarten classes.
3737 Sec. 302.0063. CHILD-CARE PROFESSIONAL DEVELOPMENT
3838 SCHOLARSHIP PROGRAM. (a) In this section, "program" means the
3939 professional development scholarship program established under
4040 this section.
4141 (b) From funds appropriated for the purpose, the commission
4242 shall establish and administer a professional development
4343 scholarship program for current and prospective child-care
4444 workers.
4545 (c) A scholarship under the program may be used to pay an
4646 individual's costs related to:
4747 (1) earning:
4848 (A) a Child Development Associate (CDA)
4949 credential; or
5050 (B) an associate's degree or bachelor's degree in
5151 early childhood education or another related field from a public or
5252 private institution of higher education; and
5353 (2) participation in a registered child-care
5454 apprenticeship program.
5555 (d) The program may be used to pay for other ancillary costs
5656 for child-care workers who are enrolled in an educational program
5757 or apprenticeship program described by Subsection (c), including:
5858 (1) books and supplies;
5959 (2) release time or stipends to attend classes;
6060 (3) costs related to the examination for the Child
6161 Development Associate (CDA) credential;
6262 (4) travel to attend classes or attend a hands-on
6363 practicum training; and
6464 (5) stipends for mentors or master teachers who
6565 provide hands-on training at a child-care program.
6666 SECTION 2. Section 2308.256(a), Government Code, is amended
6767 to read as follows:
6868 (a) A board is composed as follows:
6969 (1) representatives of the private sector, who:
7070 (A) constitute a majority of the membership of
7171 the board; and
7272 (B) are owners of business concerns, chief
7373 executives or chief operating officers of nongovernmental
7474 employers, or other private sector executives who have substantial
7575 management or policy responsibilities;
7676 (2) representatives of organized labor and
7777 community-based organizations, who constitute not less than 15
7878 percent of the membership of the board; and
7979 (3) representatives of each of the following:
8080 (A) educational agencies, including community
8181 colleges and secondary and postsecondary practitioners
8282 representing vocational education, that are representative of all
8383 educational agencies in the service delivery area;
8484 (B) vocational rehabilitation agencies;
8585 (C) public assistance agencies;
8686 (D) economic development agencies;
8787 (E) the public employment service;
8888 (F) local literacy councils; [and]
8989 (G) adult basic and continuing education
9090 organizations; and
9191 (H) the child-care workforce.
9292 SECTION 3. Section 2308.256(g), Government Code, is
9393 repealed.
9494 SECTION 4. This Act takes effect September 1, 2023.
