| 9 | 9 | | conservatorship of the Department of Family and Protective |

| 10 | 10 | | Services. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 51.978, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (c-1) to read as follows: |
|---|
| 14 | 14 | | (c-1) Notwithstanding any other provision of this section, |
|---|
| 15 | 15 | | on the request for assistance under this section of an eligible |
|---|
| 16 | 16 | | student under Subsection (b) who is also considered a homeless |
|---|
| 17 | 17 | | child or youth under 42 U.S.C. Section 11434a, an institution of |
|---|
| 18 | 18 | | higher education that maintains and operates a university housing |
|---|
| 19 | 19 | | facility for students during a period between academic terms shall |
|---|
| 20 | 20 | | provide the student access to that housing facility beginning on |
|---|
| 21 | 21 | | the last day of an academic term and ending on the first day of the |
|---|
| 22 | 22 | | immediately following academic term, according to the |
|---|
| 23 | 23 | | institution's academic calendar, at no cost to the student. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies |
|---|
| 25 | 25 | | beginning with the 2023-2024 academic year. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2023. |
