| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 442.053(a), Health and Safety Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (a) A donated prescription drug may be accepted or dispensed |
|---|
| 11 | 11 | | under this chapter only if the drug is in its original, unopened, |
|---|
| 12 | 12 | | sealed, and tamper-evident bottle, container, or unit-dose |
|---|
| 13 | 13 | | packaging. A drug packaged in single unit doses may be accepted and |
|---|
| 14 | 14 | | dispensed if the outside packaging is opened but the single |
|---|
| 15 | 15 | | unit-dose packaging is unopened. |
|---|
| 16 | 16 | | SECTION 2. This Act takes effect September 1, 2023. |
