66 AN ACT
77 relating to county and municipal regulation of automated external
88 defibrillators.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 122, Health and Safety Code, is amended
1111 by adding Section 122.009 to read as follows:
1212 Sec. 122.009. COUNTY AND MUNICIPAL REGULATION OF AUTOMATED
1313 EXTERNAL DEFIBRILLATORS. (a) In this section, "automated external
1414 defibrillator" has the meaning assigned by Section 779.001.
1515 (b) After public notice and hearing, a county or
1616 municipality by order or ordinance may require automated external
1717 defibrillators to be installed and maintained in structures subject
1818 to county or municipal licensure or other regulation to provide
1919 adequate emergency preparedness. The order or ordinance:
2020 (1) may specify the structures subject to the
2121 requirement and the minimum number and position of required
2222 automated external defibrillators;
2323 (2) may not apply to a health facility licensed under
2424 Title 4 or a premises with an occupancy limit of 30 or fewer
2525 persons; and
2626 (3) may provide exceptions and a variance process to
2727 ensure small businesses are not adversely impacted.
2828 (c) The governing body of a municipality or the
2929 commissioners court of a county shall consult with the county or
3030 municipal fire marshal, the county or municipal fire chief, or
3131 other local official with authority over emergency matters to
3232 determine whether to require automated external defibrillators
3333 under Subsection (b) and the structures subject to the requirement.
3434 (d) A county order adopted under Subsection (b) does not
3535 apply to structures within a municipality and the municipality's
3636 extraterritorial jurisdiction if the municipality has adopted an
3737 ordinance under Subsection (b). A municipal ordinance may apply to
3838 structures within the municipality's extraterritorial
3939 jurisdiction.
4040 (e) A county or municipality:
4141 (1) may inspect a structure subject to an order or
4242 ordinance adopted under Subsection (b) to ensure compliance with
4343 the order or ordinance; and
4444 (2) may not impose application or inspection fees
4545 related to an order or ordinance adopted under Subsection (b).
4646 (f) Chapter 779 applies to automated external
4747 defibrillators required under an order or ordinance adopted under
4848 Subsection (b).
4949 (g) A county or municipality and county or municipal elected
5050 or appointed officials, employees, and agents are not liable for
5151 the regulation of or failure to regulate automated external
5252 defibrillators.
5353 SECTION 2. This Act takes effect September 1, 2023.
