9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 122, Health and Safety Code, is amended |
---|
11 | 11 | | by adding Section 122.009 to read as follows: |
---|
12 | 12 | | Sec. 122.009. COUNTY AND MUNICIPAL REGULATION OF AUTOMATED |
---|
13 | 13 | | EXTERNAL DEFIBRILLATORS. (a) In this section, "automated external |
---|
14 | 14 | | defibrillator" has the meaning assigned by Section 779.001. |
---|
15 | 15 | | (b) After public notice and hearing, a county or |
---|
16 | 16 | | municipality by order or ordinance may require automated external |
---|
17 | 17 | | defibrillators to be installed and maintained in structures subject |
---|
18 | 18 | | to county or municipal licensure or other regulation to provide |
---|
19 | 19 | | adequate emergency preparedness. The order or ordinance: |
---|
20 | 20 | | (1) may specify the structures subject to the |
---|
21 | 21 | | requirement and the minimum number and position of required |
---|
22 | 22 | | automated external defibrillators; |
---|
23 | 23 | | (2) may not apply to a health facility licensed under |
---|
24 | 24 | | Title 4 or a premises with an occupancy limit of 30 or fewer |
---|
25 | 25 | | persons; and |
---|
26 | 26 | | (3) may provide exceptions and a variance process to |
---|
27 | 27 | | ensure small businesses are not adversely impacted. |
---|
28 | 28 | | (c) The governing body of a municipality or the |
---|
29 | 29 | | commissioners court of a county shall consult with the county or |
---|
30 | 30 | | municipal fire marshal, the county or municipal fire chief, or |
---|
31 | 31 | | other local official with authority over emergency matters to |
---|
32 | 32 | | determine whether to require automated external defibrillators |
---|
33 | 33 | | under Subsection (b) and the structures subject to the requirement. |
---|
34 | 34 | | (d) A county order adopted under Subsection (b) does not |
---|
35 | 35 | | apply to structures within a municipality and the municipality's |
---|
36 | 36 | | extraterritorial jurisdiction if the municipality has adopted an |
---|
37 | 37 | | ordinance under Subsection (b). A municipal ordinance may apply to |
---|
38 | 38 | | structures within the municipality's extraterritorial |
---|
39 | 39 | | jurisdiction. |
---|
40 | 40 | | (e) A county or municipality: |
---|
41 | 41 | | (1) may inspect a structure subject to an order or |
---|
42 | 42 | | ordinance adopted under Subsection (b) to ensure compliance with |
---|
43 | 43 | | the order or ordinance; and |
---|
44 | 44 | | (2) may not impose application or inspection fees |
---|
45 | 45 | | related to an order or ordinance adopted under Subsection (b). |
---|
46 | 46 | | (f) Chapter 779 applies to automated external |
---|
47 | 47 | | defibrillators required under an order or ordinance adopted under |
---|
48 | 48 | | Subsection (b). |
---|
49 | 49 | | (g) A county or municipality and county or municipal elected |
---|
50 | 50 | | or appointed officials, employees, and agents are not liable for |
---|
51 | 51 | | the regulation of or failure to regulate automated external |
---|
52 | 52 | | defibrillators. |
---|
53 | 53 | | SECTION 2. This Act takes effect September 1, 2023. |
