7 | 7 | | relating to the authority of the governing body of a hospital |
---|
8 | 8 | | district to vote for candidates for director of the appraisal |
---|
9 | 9 | | district in which the hospital district participates. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Sections 6.03(c) and (e), Tax Code, are amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (c) Members of the board of directors other than a county |
---|
14 | 14 | | assessor-collector serving as a nonvoting director are appointed by |
---|
15 | 15 | | vote of the governing bodies of the incorporated cities and towns, |
---|
16 | 16 | | the school districts, the junior college districts, the hospital |
---|
17 | 17 | | districts, and, if entitled to vote, the conservation and |
---|
18 | 18 | | reclamation districts that participate in the district and of the |
---|
19 | 19 | | county. A governing body may cast all its votes for one candidate |
---|
20 | 20 | | or distribute them among candidates for any number of |
---|
21 | 21 | | directorships. Conservation and reclamation districts are not |
---|
22 | 22 | | entitled to vote unless at least one conservation and reclamation |
---|
23 | 23 | | district in the district delivers to the chief appraiser a written |
---|
24 | 24 | | request to nominate and vote on the board of directors by June 1 of |
---|
25 | 25 | | each odd-numbered year. On receipt of a request, the chief |
---|
26 | 26 | | appraiser shall certify a list by June 15 of all eligible |
---|
27 | 27 | | conservation and reclamation districts that are imposing taxes and |
---|
28 | 28 | | that participate in the district. |
---|
29 | 29 | | (e) The chief appraiser shall calculate the number of votes |
---|
30 | 30 | | to which each taxing unit other than a conservation and reclamation |
---|
31 | 31 | | district is entitled and shall deliver written notice to each of |
---|
32 | 32 | | those taxing units of its voting entitlement before October 1 of |
---|
33 | 33 | | each odd-numbered year. The chief appraiser shall deliver the |
---|
34 | 34 | | notice: |
---|
35 | 35 | | (1) to the county judge and each commissioner of the |
---|
36 | 36 | | county served by the appraisal district; |
---|
37 | 37 | | (2) to the presiding officer of the governing body of |
---|
38 | 38 | | each city or town participating in the appraisal district, to the |
---|
39 | 39 | | city manager of each city or town having a city manager, and to the |
---|
40 | 40 | | city secretary or clerk, if there is one, of each city or town that |
---|
41 | 41 | | does not have a city manager; |
---|
42 | 42 | | (3) to the presiding officer of the governing body of |
---|
43 | 43 | | each school district participating in the district and to the |
---|
44 | 44 | | superintendent of those school districts; [and] |
---|
45 | 45 | | (4) to the presiding officer of the governing body of |
---|
46 | 46 | | each junior college district participating in the district and to |
---|
47 | 47 | | the president, chancellor, or other chief executive officer of |
---|
48 | 48 | | those junior college districts; and |
---|
49 | 49 | | (5) to the presiding officer of the governing body and |
---|
50 | 50 | | the hospital administrator of each hospital district participating |
---|
51 | 51 | | in the district. |
---|
52 | 52 | | SECTION 2. The changes in law made by this Act apply only to |
---|
53 | 53 | | the selection of appraisal district directors for terms that begin |
---|
54 | 54 | | on or after January 1, 2024. |
---|
55 | 55 | | SECTION 3. This Act takes effect immediately if it receives |
---|
56 | 56 | | a vote of two-thirds of all the members elected to each house, as |
---|
57 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
58 | 58 | | Act does not receive the vote necessary for immediate effect, this |
---|
59 | 59 | | Act takes effect September 1, 2023. |
