55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of the governing body of a hospital
88 district to vote for candidates for director of the appraisal
99 district in which the hospital district participates.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 6.03(c) and (e), Tax Code, are amended
1212 to read as follows:
1313 (c) Members of the board of directors other than a county
1414 assessor-collector serving as a nonvoting director are appointed by
1515 vote of the governing bodies of the incorporated cities and towns,
1616 the school districts, the junior college districts, the hospital
1717 districts, and, if entitled to vote, the conservation and
1818 reclamation districts that participate in the district and of the
1919 county. A governing body may cast all its votes for one candidate
2020 or distribute them among candidates for any number of
2121 directorships. Conservation and reclamation districts are not
2222 entitled to vote unless at least one conservation and reclamation
2323 district in the district delivers to the chief appraiser a written
2424 request to nominate and vote on the board of directors by June 1 of
2525 each odd-numbered year. On receipt of a request, the chief
2626 appraiser shall certify a list by June 15 of all eligible
2727 conservation and reclamation districts that are imposing taxes and
2828 that participate in the district.
2929 (e) The chief appraiser shall calculate the number of votes
3030 to which each taxing unit other than a conservation and reclamation
3131 district is entitled and shall deliver written notice to each of
3232 those taxing units of its voting entitlement before October 1 of
3333 each odd-numbered year. The chief appraiser shall deliver the
3434 notice:
3535 (1) to the county judge and each commissioner of the
3636 county served by the appraisal district;
3737 (2) to the presiding officer of the governing body of
3838 each city or town participating in the appraisal district, to the
3939 city manager of each city or town having a city manager, and to the
4040 city secretary or clerk, if there is one, of each city or town that
4141 does not have a city manager;
4242 (3) to the presiding officer of the governing body of
4343 each school district participating in the district and to the
4444 superintendent of those school districts; [and]
4545 (4) to the presiding officer of the governing body of
4646 each junior college district participating in the district and to
4747 the president, chancellor, or other chief executive officer of
4848 those junior college districts; and
4949 (5) to the presiding officer of the governing body and
5050 the hospital administrator of each hospital district participating
5151 in the district.
5252 SECTION 2. The changes in law made by this Act apply only to
5353 the selection of appraisal district directors for terms that begin
5454 on or after January 1, 2024.
5555 SECTION 3. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2023.
