| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 42, Local Government Code, |
|---|
| 13 | 13 | | is amended by adding Section 42.905 to read as follows: |

| 14 | 14 | | Sec. 42.905. PROVISION OF MUNICIPAL SERVICES IN |
|---|
| 15 | 15 | | EXTRATERRITORIAL JURISDICTION UNDER CERTAIN CIRCUMSTANCES. A |
|---|
| 16 | 16 | | municipality that extends to its extraterritorial jurisdiction the |
|---|
| 17 | 17 | | application of a municipal ordinance or rule and denies or refuses |
|---|
| 18 | 18 | | to permit an activity or structure on a property in that area under |
|---|
| 19 | 19 | | the ordinance or rule shall provide to the property the municipal |
|---|
| 20 | 20 | | services described by Section 43.056(b) not later than 30 months |
|---|
| 21 | 21 | | after the date of the denial or refusal. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect September 1, 2023. |
