88 AN ACT
99 relating to the summary suspension of a nursing license in
1010 connection with a fraudulently or unlawfully obtained diploma,
1111 license, or other document.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 301.454(a), Occupations Code, is amended
1414 to read as follows:
1515 (a) Except in the case of a temporary suspension authorized
1616 under Section 301.455, [or] 301.4551, or 301.4552, or an action
1717 taken in accordance with an agreement between the board and a
1818 license holder, the board may not take any disciplinary action
1919 relating to a license unless:
2020 (1) the board has served notice to the license holder
2121 of the facts or conduct alleged to warrant the intended action; and
2222 (2) the license holder has been given an opportunity,
2323 in writing or through an informal meeting, to show compliance with
2424 all requirements of law for the retention of the license.
2525 SECTION 2. Subchapter J, Chapter 301, Occupations Code, is
2626 amended by adding Section 301.4552 to read as follows:
2727 Sec. 301.4552. SUMMARY SUSPENSION FOR CERTAIN VIOLATIONS
2828 INVOLVING FRAUDULENT CONDUCT. (a) Notwithstanding any other law,
2929 on a showing of probable cause that the holder of a license issued
3030 under this chapter has violated Section 301.451(1), (2), or (3),
3131 the board may issue an order suspending the license without notice.
3232 A showing of probable cause that an individual has violated Section
3333 301.451(1), (2), or (3) constitutes a continuing and imminent
3434 threat to the public welfare.
3535 (b) On the issuance of a summary suspension order under this
3636 section, the board shall serve notice of the suspension, including
3737 the basis for the suspension, personally or by certified mail, on
3838 the individual whose license is suspended at the individual's last
3939 known address on file with the board. Service is complete when the
4040 board personally serves the individual or sends the notice.
4141 (c) An individual whose license is suspended under this
4242 section may request a hearing to be held by the State Office of
4343 Administrative Hearings. A hearing requested under this section
4444 must be held not later than the 90th day after the date the order of
4545 suspension was issued. If a hearing is not requested under this
4646 subsection on or before the 20th business day after the date the
4747 suspension order was issued, the right to a hearing is waived and
4848 the license shall remain suspended.
4949 (d) In a hearing under this section, the State Office of
5050 Administrative Hearings shall consider whether evidence exists to
5151 support a finding that the individual violated Section 301.451(1),
5252 (2), or (3). The individual shall have the opportunity to rebut the
5353 evidence that provided the basis for the summary suspension. The
5454 individual has the burden of proving by a preponderance of the
5555 evidence that the license was lawfully obtained if the individual
5656 submitted, as part of the individual's application, a transcript,
5757 diploma, or other document required for licensure that was issued
5858 or purportedly issued by an entity that has been implicated in a
5959 scheme of fraud relating to the issuance of transcripts, diplomas,
6060 or similar documents.
6161 (e) If the State Office of Administrative Hearings makes a
6262 finding in a hearing under this section that an individual violated
6363 Section 301.451(1), (2), or (3), the board shall issue an order
6464 revoking the individual's license. If the State Office of
6565 Administrative Hearings makes a finding in a hearing under this
6666 section that an individual did not violate Section 301.451(1), (2),
6767 or (3), the board shall immediately issue an order to reinstate the
6868 individual's license.
6969 (f) An individual whose license is revoked under Subsection
7070 (e) may not apply for a license under this chapter until:
7171 (1) the first anniversary of the date of issuance of
7272 the order revoking the license under Subsection (e); and
7373 (2) the applicant provides evidence of completion of a
7474 nursing education program that meets the requirements of Section
7575 301.157 and board rules adopted under that section.
7676 SECTION 3. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2023.
