| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 392, Local Government |
|---|
| 11 | 11 | | Code, is amended by adding Section 392.068 to read as follows: |

| 12 | 12 | | Sec. 392.068. PRIORITY PLACEMENT FOR CERTAIN YOUTH AGING |
|---|
| 13 | 13 | | OUT OF FOSTER CARE. (a) This section applies only to a housing |
|---|
| 14 | 14 | | authority located in a municipality that contains more than 70 |
|---|
| 15 | 15 | | percent of the population of a county with a population of 1.5 |
|---|
| 16 | 16 | | million or more. |
|---|
| 17 | 17 | | (b) In providing affordable housing, a housing authority to |
|---|
| 18 | 18 | | which this section applies shall give first priority to youth aging |
|---|
| 19 | 19 | | out of foster care who reside in the authority's area of operation. |
|---|
| 20 | 20 | | (c) A housing authority to which this section applies that |
|---|
| 21 | 21 | | manages a waitlist for the provision of affordable housing must |
|---|
| 22 | 22 | | give first priority on the waitlist to youth aging out of foster |
|---|
| 23 | 23 | | care who reside in the authority's area of operation. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
