55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the medical accuracy of informational materials given
88 to a woman seeking an abortion.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 171.014(d), Health and Safety Code, is
1111 amended to read as follows:
1212 (d) The department shall annually review the materials to
1313 determine if changes to the contents of the materials are
1414 necessary. The executive commissioner shall adopt rules necessary
1515 for considering and making changes to the materials, including
1616 rules requiring the department to:
1717 (1) periodically submit the materials to the American
1818 College of Obstetricians and Gynecologists to verify that the
1919 materials are medically accurate; and
2020 (2) revise the materials to incorporate any
2121 recommendations from the American College of Obstetricians and
2222 Gynecologists for improving the medical accuracy of the materials.
2323 SECTION 2. As soon as practicable after the effective date
2424 of this Act, the executive commissioner of the Health and Human
2525 Services Commission shall adopt rules necessary to implement the
2626 changes in law made by this Act.
2727 SECTION 3. This Act takes effect September 1, 2023.
