| 7 | 7 | | relating to the medical accuracy of informational materials given |

| 8 | 8 | | to a woman seeking an abortion. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 171.014(d), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (d) The department shall annually review the materials to |
|---|
| 13 | 13 | | determine if changes to the contents of the materials are |
|---|
| 14 | 14 | | necessary. The executive commissioner shall adopt rules necessary |
|---|
| 15 | 15 | | for considering and making changes to the materials, including |
|---|
| 16 | 16 | | rules requiring the department to: |
|---|
| 17 | 17 | | (1) periodically submit the materials to the American |
|---|
| 18 | 18 | | College of Obstetricians and Gynecologists to verify that the |
|---|
| 19 | 19 | | materials are medically accurate; and |
|---|
| 20 | 20 | | (2) revise the materials to incorporate any |
|---|
| 21 | 21 | | recommendations from the American College of Obstetricians and |
|---|
| 22 | 22 | | Gynecologists for improving the medical accuracy of the materials. |
|---|
| 23 | 23 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 24 | 24 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 25 | 25 | | Services Commission shall adopt rules necessary to implement the |
|---|
| 26 | 26 | | changes in law made by this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2023. |
