99 relating to municipally owned utility vegetation management.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 552, Local Government
1212 Code, is amended by adding Section 552.915 to read as follows:
1313 Sec. 552.915. PROHIBITION ON TRANSFER OF MUNICIPAL UTILITY
1414 REVENUE. (a) In this section:
1515 (1) "Commission" means the Public Utility Commission
1616 of Texas.
1717 (2) "Municipal utility" means an electric utility
1818 system owned, operated, or controlled by a municipality.
1919 (b) If the commission determines under Section 38.101,
2020 Utilities Code, that a municipal utility's vegetation management
2121 activities are insufficient to ensure reliable service, except as
2222 provided by Subsection (c) and notwithstanding any other law, the
2323 municipality may not in the fiscal year of the determination
2424 transfer revenue to the general fund of the municipality from the
2525 municipal utility that the municipal utility needs to conduct
2626 sufficient vegetation management activities to ensure reliable
2727 service.
2828 (c) The commission shall provide the municipality with a
2929 reasonable grace period after the commission provides a notice to
3030 the municipal utility under Section 38.101(c), Utilities Code, in
3131 which the municipality may continue to transfer revenue as
3232 described by Subsection (b) while the utility alters the utility's
3333 vegetation management activities to ensure reliable service.
3434 SECTION 2. Section 38.101, Utilities Code, is amended to
3535 read as follows:
3636 Sec. 38.101. REPORT ON INFRASTRUCTURE IMPROVEMENT AND
3737 MAINTENANCE. (a) Not later than May 1 of each year, each electric
3838 utility and municipally owned utility shall submit to the
3939 commission a report describing the utility's activities related to:
4040 (1) identifying areas that are susceptible to damage
4141 during severe weather and hardening transmission and distribution
4242 facilities in those areas;
4343 (2) vegetation management; and
4444 (3) inspecting distribution poles.
4545 (b) Each electric utility and municipally owned utility
4646 shall include in a report required under Subsection (a) a summary of
4747 the utility's activities related to preparing for emergency
4848 operations.
4949 (c) The commission shall evaluate each report submitted by a
5050 municipally owned utility under this section and notify the utility
5151 if the commission determines that the utility's vegetation
5252 management activities are insufficient to ensure reliable service.
5353 SECTION 3. This Act takes effect September 1, 2023.
