7 | 7 | | adopted by the State Board of Education for the governance of a |

8 | 8 | | special-purpose district. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 11.352(b) and (c), Education Code, are |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (b) For each military reservation school district, the |
---|
13 | 13 | | State Board of Education may appoint a board of three or five |
---|
14 | 14 | | trustees. Enlisted military personnel and military officers may be |
---|
15 | 15 | | appointed to the school board. A majority of the trustees appointed |
---|
16 | 16 | | for the district must be civilians and all may be civilians. The |
---|
17 | 17 | | trustees shall be selected from a list of persons who are qualified |
---|
18 | 18 | | to serve as members of a school district board of trustees under |
---|
19 | 19 | | Section 11.061 and who live on or are employed on the military |
---|
20 | 20 | | reservation. A person who retires from active duty or civilian |
---|
21 | 21 | | service while serving a term as a member of the board of trustees |
---|
22 | 22 | | may continue to serve for the remainder of that person's term. The |
---|
23 | 23 | | list shall be furnished to the board by the commanding officer of |
---|
24 | 24 | | the military reservation. The trustees appointed serve terms of |
---|
25 | 25 | | two years. |
---|
26 | 26 | | (c) The State Board of Education shall [may] adopt rules for |
---|
27 | 27 | | the governance of a special-purpose district. In the absence of a |
---|
28 | 28 | | rule adopted under this subsection, the laws applicable to |
---|
29 | 29 | | independent school districts apply to a special-purpose district. |
---|
30 | 30 | | SECTION 2. This Act takes effect September 1, 2023. |
