55 relating to the qualifications to serve as a member of a board of
66 trustees of a military reservation school district and rules
77 adopted by the State Board of Education for the governance of a
88 special-purpose district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 11.352(b) and (c), Education Code, are
1111 amended to read as follows:
1212 (b) For each military reservation school district, the
1313 State Board of Education may appoint a board of three or five
1414 trustees. Enlisted military personnel and military officers may be
1515 appointed to the school board. A majority of the trustees appointed
1616 for the district must be civilians and all may be civilians. The
1717 trustees shall be selected from a list of persons who are qualified
1818 to serve as members of a school district board of trustees under
1919 Section 11.061 and who live on or are employed on the military
2020 reservation. A person who retires from active duty or civilian
2121 service while serving a term as a member of the board of trustees
2222 may continue to serve for the remainder of that person's term. The
2323 list shall be furnished to the board by the commanding officer of
2424 the military reservation. The trustees appointed serve terms of
2525 two years.
2626 (c) The State Board of Education shall [may] adopt rules for
2727 the governance of a special-purpose district. In the absence of a
2828 rule adopted under this subsection, the laws applicable to
2929 independent school districts apply to a special-purpose district.
3030 SECTION 2. This Act takes effect September 1, 2023.
