| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter Z, Chapter 552, Local Government |
|---|
| 10 | 10 | | Code, is amended by adding Section 552.9061 to read as follows: |
|---|
| 11 | 11 | | Sec. 552.9061. PARTICIPATION IN WHOLESALE ELECTRIC MARKET. |
|---|
| 12 | 12 | | Notwithstanding any other law, a municipally owned utility may not |
|---|
| 13 | 13 | | sell electric energy at wholesale if the utility has, during the |
|---|
| 14 | 14 | | preceding five municipal fiscal years, earned less revenue from |
|---|
| 15 | 15 | | wholesale sales in the electricity market than the utility has |
|---|
| 16 | 16 | | spent. |

| 17 | 17 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 18 | 18 | | to a municipal fiscal year that begins on or after the effective |
|---|
| 19 | 19 | | date of this Act. |
|---|
| 20 | 20 | | SECTION 3. This Act takes effect September 1, 2023. |
