66 AN ACT
77 relating to a study conducted by the Railroad Commission of Texas to
88 determine the net reduction in the amount of carbon dioxide in the
99 atmosphere resulting from the use of carbon capture, utilization,
1010 and storage technology.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITIONS. In this Act:
1313 (1) "Carbon capture technology" means technology that
1414 captures, stores, and uses high concentrations of carbon dioxide.
1515 (2) "Commission" means the Railroad Commission of
1616 Texas.
1717 SECTION 2. STUDY. (a) The commission shall conduct a study
1818 of ongoing carbon capture technology projects to:
1919 (1) assess the net reduction in the amount of carbon
2020 dioxide in the atmosphere resulting from the use of carbon capture
2121 technology; and
2222 (2) determine whether each carbon capture technology
2323 examined removes more carbon dioxide from the atmosphere than it
2424 contributes.
2525 (b) In conducting the study under Subsection (a) of this
2626 section, the commission shall:
2727 (1) establish an accounting framework that includes a
2828 project life-cycle analysis to determine the net amount of carbon
2929 dioxide sequestered from projects using carbon capture technology;
3030 and
3131 (2) coordinate with the Bureau of Economic Geology of
3232 The University of Texas at Austin, the Texas Commission on
3333 Environmental Quality, and other appropriate agencies.
3434 (c) For a carbon capture technology project included in the
3535 study under Subsection (a) of this section, the study must:
3636 (1) establish a method of accurately measuring and
3737 reporting the volumes of carbon dioxide captured by the project;
3838 (2) accurately identify the amount of carbon dioxide
3939 the project removes from the atmosphere; and
4040 (3) determine whether the project provides a net
4141 reduction of carbon dioxide in the atmosphere over the project's
4242 life-cycle based on the amount of carbon dioxide removed and the
4343 amount of carbon dioxide emitted by the sequestration activities.
4444 (d) To the extent that carbon capture technology projects
4545 are used for enhanced oil recovery operations, the study must:
4646 (1) account for whether those enhanced oil recovery
4747 operations on the whole result in:
4848 (A) an increase of the total amount of the oil
4949 produced by operations using that technology and by operations not
5050 using that technology; or
5151 (B) a decrease in the amount of oil produced by
5252 operations not using that technology in an amount that equals or
5353 exceeds the amount of oil produced by operations using that
5454 technology; and
5555 (2) account for contributions to the atmosphere of
5656 carbon dioxide from the projects.
5757 SECTION 3. REPORT. Not later than September 1, 2024, the
5858 commission shall prepare and submit a report to the legislature
5959 that includes:
6060 (1) the methodology used to perform the study;
6161 (2) the information already available to the
6262 commission and any information needed to provide an accurate
6363 accounting of how much carbon dioxide each carbon capture
6464 technology project removes from the atmosphere;
6565 (3) the information needed to assess different types
6666 of carbon capture technology, including direct air capture
6767 technology; and
6868 (4) a framework that would allow the commission to
6969 accurately assess the effectiveness of all ongoing carbon capture
7070 technology projects and the likely effectiveness of carbon capture
7171 technology projects to be considered in the future.
7272 SECTION 4. EXPIRATION. This Act expires September 1, 2025.
7373 SECTION 5. EFFECTIVE DATE. This Act takes effect September
7474 1, 2023.
