| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 1579.155(a) and (c), Insurance Code, |
|---|
| 12 | 12 | | are amended to read as follows: |
|---|
| 13 | 13 | | (a) Effective September 1, 2022, a participating entity may |
|---|
| 14 | 14 | | elect to discontinue the entity's participation in the program by |
|---|
| 15 | 15 | | providing written notice to the trustee not later than May |
|---|
| 16 | 16 | | [December] 31 of the year preceding the first day of the plan year |
|---|
| 17 | 17 | | in which the election will be effective. |
|---|
| 18 | 18 | | (c) Effective September 1, 2022, an entity that elects to |
|---|
| 19 | 19 | | participate in the program shall provide written notice to the |
|---|
| 20 | 20 | | trustee not later than May [December] 31 of the year preceding the |
|---|
| 21 | 21 | | first day of the plan year in which the election will be effective. |
|---|
| 22 | 22 | | The entity may not elect to discontinue the entity's participation |
|---|
| 23 | 23 | | until the fifth anniversary of the effective date of the entity's |
|---|
| 24 | 24 | | election to participate. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
