55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to retirees of the Teacher Retirement System of Texas who
88 resume certain employment with a school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 825.4092(e), Government Code, is amended
1111 to read as follows:
1212 (e) The amounts required to be paid under Subsections (b)
1313 and (c) are not required to be paid by a reporting employer for a
1414 retiree who retired from the retirement system:
1515 (1) before September 1, 2005; or
1616 (2) on or after September 1, 2005, if:
1717 (A) the retiree's employment qualifies for an
1818 exception under Section 824.601(b-1) or 824.602(a)(3) to the loss
1919 of benefit payments described by Section 824.601(b); and
2020 (B) the reporting employer demonstrates to the
2121 Texas Education Agency that the employer cannot through reasonable
2222 efforts fill the position other than with a person working on a
2323 temporary basis.
2424 SECTION 2. The changes in law made by this Act apply to a
2525 retiree of the Teacher Retirement System of Texas regardless of
2626 whether the person retired from employment before, on, or after the
2727 effective date of this Act.
2828 SECTION 3. The changes in law made by this Act apply
2929 beginning with the 2023-2024 school year.
3030 SECTION 4. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2023.
