| 7 | 7 | | relating to retirees of the Teacher Retirement System of Texas who |
|---|
| 8 | 8 | | resume certain employment with a school district. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 825.4092(e), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (e) The amounts required to be paid under Subsections (b) |
|---|
| 13 | 13 | | and (c) are not required to be paid by a reporting employer for a |
|---|
| 14 | 14 | | retiree who retired from the retirement system: |
|---|
| 15 | 15 | | (1) before September 1, 2005; or |
|---|
| 16 | 16 | | (2) on or after September 1, 2005, if: |
|---|
| 17 | 17 | | (A) the retiree's employment qualifies for an |
|---|
| 18 | 18 | | exception under Section 824.601(b-1) or 824.602(a)(3) to the loss |
|---|
| 19 | 19 | | of benefit payments described by Section 824.601(b); and |
|---|
| 20 | 20 | | (B) the reporting employer demonstrates to the |
|---|
| 21 | 21 | | Texas Education Agency that the employer cannot through reasonable |
|---|
| 22 | 22 | | efforts fill the position other than with a person working on a |
|---|
| 23 | 23 | | temporary basis. |

| 24 | 24 | | SECTION 2. The changes in law made by this Act apply to a |
|---|
| 25 | 25 | | retiree of the Teacher Retirement System of Texas regardless of |
|---|
| 26 | 26 | | whether the person retired from employment before, on, or after the |
|---|
| 27 | 27 | | effective date of this Act. |
|---|
| 28 | 28 | | SECTION 3. The changes in law made by this Act apply |
|---|
| 29 | 29 | | beginning with the 2023-2024 school year. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2023. |
