7	7	relating to the disclosure of certain documentation and records
8	8	concerning victims of sexual assault and other sex offenses.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Article 56A.252, Code of Criminal Procedure, is
11	11	amended by adding Subsection (c-1) to read as follows:
12	12	(c-1) For purposes of this subsection, "intimate parts" and
13	13	"visual material" have the meanings assigned by Section 21.16,
14	14	Penal Code. In providing documentation in support of additional
15	15	reimbursement under Subsection (c)(1)(B), a health care provider or
16	16	sexual assault examiner may redact any personally identifiable
17	17	information of a sexual assault survivor and withhold any visual
18	18	material depicting a sexual assault survivor with the survivor's
19	19	intimate parts exposed or otherwise depicting the survivor in an
20	20	intimate state.
21	21	SECTION 2. Section 420.072, Government Code, is amended by
22	22	adding Subsection (a-1) to read as follows:
23	23	(a-1) For purposes of this subsection, "intimate parts" and
24	24	"visual material" have the meanings assigned by Section 21.16,
25	25	Penal Code. In disclosing a communication or record for purposes of
26	26	an audit, an evaluation, or research under Subsection (a)(5)(B), an
27	27	advocate or sexual assault program may redact any personally
28	28	identifiable information of a survivor and withhold any visual
29	29	material depicting a survivor with the survivor's intimate parts
30	30	exposed or otherwise depicting the survivor in an intimate state.
31	31	SECTION 3. This Act takes effect September 1, 2023.
