9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Article 56A.252, Code of Criminal Procedure, is |
---|
11 | 11 | | amended by adding Subsection (c-1) to read as follows: |
---|
12 | 12 | | (c-1) For purposes of this subsection, "intimate parts" and |
---|
13 | 13 | | "visual material" have the meanings assigned by Section 21.16, |
---|
14 | 14 | | Penal Code. In providing documentation in support of additional |
---|
15 | 15 | | reimbursement under Subsection (c)(1)(B), a health care provider or |
---|
16 | 16 | | sexual assault examiner may redact any personally identifiable |
---|
17 | 17 | | information of a sexual assault survivor and withhold any visual |
---|
18 | 18 | | material depicting a sexual assault survivor with the survivor's |
---|
19 | 19 | | intimate parts exposed or otherwise depicting the survivor in an |
---|
20 | 20 | | intimate state. |

21 | 21 | | SECTION 2. Section 420.072, Government Code, is amended by |
---|
22 | 22 | | adding Subsection (a-1) to read as follows: |
---|
23 | 23 | | (a-1) For purposes of this subsection, "intimate parts" and |
---|
24 | 24 | | "visual material" have the meanings assigned by Section 21.16, |
---|
25 | 25 | | Penal Code. In disclosing a communication or record for purposes of |
---|
26 | 26 | | an audit, an evaluation, or research under Subsection (a)(5)(B), an |
---|
27 | 27 | | advocate or sexual assault program may redact any personally |
---|
28 | 28 | | identifiable information of a survivor and withhold any visual |
---|
29 | 29 | | material depicting a survivor with the survivor's intimate parts |
---|
30 | 30 | | exposed or otherwise depicting the survivor in an intimate state. |
---|
31 | 31 | | SECTION 3. This Act takes effect September 1, 2023. |
