66 AN ACT
77 relating to the disclosure of certain documentation and records
88 concerning victims of sexual assault and other sex offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 56A.252, Code of Criminal Procedure, is
1111 amended by adding Subsection (c-1) to read as follows:
1212 (c-1) For purposes of this subsection, "intimate parts" and
1313 "visual material" have the meanings assigned by Section 21.16,
1414 Penal Code. In providing documentation in support of additional
1515 reimbursement under Subsection (c)(1)(B), a health care provider or
1616 sexual assault examiner may redact any personally identifiable
1717 information of a sexual assault survivor and withhold any visual
1818 material depicting a sexual assault survivor with the survivor's
1919 intimate parts exposed or otherwise depicting the survivor in an
2020 intimate state.
2121 SECTION 2. Section 420.072, Government Code, is amended by
2222 adding Subsection (a-1) to read as follows:
2323 (a-1) For purposes of this subsection, "intimate parts" and
2424 "visual material" have the meanings assigned by Section 21.16,
2525 Penal Code. In disclosing a communication or record for purposes of
2626 an audit, an evaluation, or research under Subsection (a)(5)(B), an
2727 advocate or sexual assault program may redact any personally
2828 identifiable information of a survivor and withhold any visual
2929 material depicting a survivor with the survivor's intimate parts
3030 exposed or otherwise depicting the survivor in an intimate state.
3131 SECTION 3. This Act takes effect September 1, 2023.
