| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 773.050, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (j) to read as follows: |
|---|
| 12 | 12 | | (j) The executive commissioner by rule shall, in a manner |
|---|
| 13 | 13 | | consistent with Section 773.112, require each emergency medical |
|---|
| 14 | 14 | | services provider to adopt and implement a procedure for providing, |
|---|
| 15 | 15 | | during a declared disaster, an alternative mode of transportation |
|---|
| 16 | 16 | | for a dialysis patient from the patient's location directly to an |
|---|
| 17 | 17 | | outpatient end stage renal disease facility when the patient's |
|---|
| 18 | 18 | | normal mode of transportation is unavailable because of the |
|---|
| 19 | 19 | | declared disaster. Each emergency medical services provider shall |
|---|
| 20 | 20 | | promptly submit a copy of the adopted procedure to the department. |
|---|
| 21 | 21 | | For purposes of this subsection: |
|---|
| 22 | 22 | | (1) "Disaster" has the meaning assigned by Section |
|---|
| 23 | 23 | | 418.004, Government Code. The term includes a disaster declared |
|---|
| 24 | 24 | | by: |
|---|
| 25 | 25 | | (A) the president of the United States under the |
|---|
| 26 | 26 | | Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 |
|---|
| 27 | 27 | | U.S.C. Section 5121 et seq.); and |
|---|
| 28 | 28 | | (B) the governor under Section 418.014, |
|---|
| 29 | 29 | | Government Code. |
|---|
| 30 | 30 | | (2) "End stage renal disease facility" has the meaning |
|---|
| 31 | 31 | | assigned by Section 251.001. |
|---|
| 32 | 32 | | SECTION 2. Section 773.112(d), Health and Safety Code, is |
|---|
| 33 | 33 | | repealed. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2023. |
