66 AN ACT
77 relating to transportation procedures for certain end stage renal
88 disease facility patients during a declared disaster.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 773.050, Health and Safety Code, is
1111 amended by adding Subsection (j) to read as follows:
1212 (j) The executive commissioner by rule shall, in a manner
1313 consistent with Section 773.112, require each emergency medical
1414 services provider to adopt and implement a procedure for providing,
1515 during a declared disaster, an alternative mode of transportation
1616 for a dialysis patient from the patient's location directly to an
1717 outpatient end stage renal disease facility when the patient's
1818 normal mode of transportation is unavailable because of the
1919 declared disaster. Each emergency medical services provider shall
2020 promptly submit a copy of the adopted procedure to the department.
2121 For purposes of this subsection:
2222 (1) "Disaster" has the meaning assigned by Section
2323 418.004, Government Code. The term includes a disaster declared
2424 by:
2525 (A) the president of the United States under the
2626 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42
2727 U.S.C. Section 5121 et seq.); and
2828 (B) the governor under Section 418.014,
2929 Government Code.
3030 (2) "End stage renal disease facility" has the meaning
3131 assigned by Section 251.001.
3232 SECTION 2. Section 773.112(d), Health and Safety Code, is
3333 repealed.
3434 SECTION 3. This Act takes effect September 1, 2023.
