| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Sections 802.003(a) and (b), Occupations Code, |
|---|
| 9 | 9 | | are amended to read as follows: |
|---|
| 10 | 10 | | (a) Except as provided by Section 802.0031, this [This] |

| 11 | 11 | | chapter does not affect the applicability of any other law, rule, |
|---|
| 12 | 12 | | order, ordinance, or other legal requirement of the federal |
|---|
| 13 | 13 | | government, this state, or a political subdivision of this state. |

| 14 | 14 | | (b) Except as provided by Section 802.0031, this [This] |

| 15 | 15 | | chapter does not prevent a municipality or county from prohibiting |

| 16 | 16 | | or further regulating by order or ordinance the possession, |

| 17 | 17 | | breeding, or selling of dogs or cats. |

| 18 | 18 | | SECTION 2. Subchapter A, Chapter 802, Occupations Code, is |
|---|
| 19 | 19 | | amended by adding Section 802.0031 to read as follows: |
|---|
| 20 | 20 | | Sec. 802.0031. SALE OF DOG OR CAT BY FOR-PROFIT BUSINESS; |
|---|
| 21 | 21 | | PREEMPTION. A municipality or county may not adopt or enforce an |
|---|
| 22 | 22 | | ordinance, order, regulation, or similar measure that prohibits the |
|---|
| 23 | 23 | | sale of a dog or cat by a for-profit business otherwise in |
|---|
| 24 | 24 | | compliance with state law. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
