88 AN ACT
99 relating to the confidentiality of certain information maintained
1010 by state licensing agencies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.1176, Government Code, is amended by
1313 amending Subsection (a) and adding Subsections (d) and (e) to read
1414 as follows:
1515 (a) Information maintained under Chapter 81 is confidential
1616 and may not be disclosed to the public under this chapter if the
1717 information:
1818 (1) is a license application; or
1919 (2) [that] relates to the home address, home telephone
2020 number, electronic mail address, social security number, [or] date
2121 of birth, driver's license number, state identification number,
2222 passport number, emergency contact information, or payment
2323 information of an individual [a person] licensed to practice law in
2424 this state [that is maintained under Chapter 81 is confidential and
2525 may not be disclosed to the public under this chapter if the person
2626 to whom the information relates:
2727 [(1) chooses to restrict public access to the
2828 information; and
2929 [(2) notifies the State Bar of Texas of the person's
3030 choice, in writing or electronically, on a form provided by the
3131 state bar].
3232 (d) Subsection (a) does not make confidential or except from
3333 required public disclosure the name, state bar identification
3434 number, membership class, or eligibility to practice law of an
3535 applicant for a license, a license holder, or an individual who
3636 previously held a license.
3737 (e) To the extent of any conflict, this section prevails
3838 over another law that authorizes or requires the release of
3939 information maintained by the State Bar of Texas.
4040 SECTION 2. Subchapter C, Chapter 552, Government Code, is
4141 amended by adding Section 552.11765 to read as follows:
4242 Sec. 552.11765. CONFIDENTIALITY OF CERTAIN INFORMATION
4343 MAINTAINED BY STATE LICENSING AUTHORITY. (a) In this section,
4444 "license" means a license, certificate, registration, permit, or
4545 other authorization that:
4646 (1) is issued by a governmental body described by
4747 Section 552.003(1)(A)(i); and
4848 (2) an individual must obtain to practice or engage in
4949 a particular business, occupation, or profession.
5050 (b) Except as provided by Subsections (c) and (d),
5151 information maintained by a governmental body described by Section
5252 552.003(1)(A)(i) is confidential and excepted from the
5353 requirements of Section 552.021 if the information:
5454 (1) is a license application; or
5555 (2) relates to the home address, home telephone
5656 number, electronic mail address, social security number, date of
5757 birth, driver's license number, state identification number,
5858 passport number, emergency contact information, or payment
5959 information of:
6060 (A) an applicant for a license issued by the
6161 governmental body;
6262 (B) an individual who holds a license issued by
6363 the governmental body; or
6464 (C) an individual who previously held a license
6565 issued by the governmental body.
6666 (c) Subsection (b) does not make confidential or except from
6767 required public disclosure the name, license number, or license
6868 status of an applicant for a license, a license holder, or an
6969 individual who previously held a license.
7070 (d) For a license issued under Chapter 42, 43, 103, or 161,
7171 Human Resources Code, or Chapter 142, 242, 247, 248A, 250, or 252,
7272 Health and Safety Code, Subsection (b) does not prohibit the
7373 disclosure of:
7474 (1) the last four digits of the social security number
7575 of a license holder in connection with a verification of
7676 employability or an employee misconduct registry search provided by
7777 the Health and Human Services Commission;
7878 (2) a home address where activity regulated by the
7979 licensing authority occurs; or
8080 (3) an e-mail address or phone number associated with
8181 activity regulated by the licensing authority.
8282 (e) To the extent of any conflict, this section prevails
8383 over another law that authorizes or requires the release of
8484 information maintained by a governmental body.
8585 SECTION 3. Subchapter D, Chapter 507, Occupations Code, is
8686 amended by adding Section 507.161 to read as follows:
8787 Sec. 507.161. CONFIDENTIALITY OF HOME ADDRESS AND TELEPHONE
8888 NUMBER. Except as provided by Section 507.160(d), the home address
8989 and telephone number of a license holder are confidential and not
9090 subject to disclosure under Chapter 552, Government Code.
9191 SECTION 4. Section 552.1176(b), Government Code, is
9292 repealed.
9393 SECTION 5. The changes in law made by this Act apply only to
9494 a request for public information received by a governmental body,
9595 including the State Bar of Texas, or an officer for public
9696 information on or after the effective date of this Act.
9797 SECTION 6. This Act takes effect September 1, 2023.
