55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on the recidivism rate of defendants who
88 complete a veterans treatment court program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 124, Government Code, is amended by
1111 adding Section 124.008 to read as follows:
1212 Sec. 124.008. RECIDIVISM STUDY. (a) In this section,
1313 "council" means the Texas Judicial Council.
1414 (b) The council, in collaboration with the Texas Veterans
1515 Commission, shall conduct a study to evaluate the recidivism rate
1616 of defendants who successfully completed a veterans treatment court
1717 program in the preceding 10 years. The report must include:
1818 (1) the recidivism rate, calculated by determining
1919 from available information the percentage of defendants who have,
2020 since completing the program:
2121 (A) been arrested for an offense alleged to have
2222 been committed after the defendant completed the program;
2323 (B) been convicted of an offense committed after
2424 the defendant completed the program;
2525 (C) had a term of community supervision revoked
2626 due to a technical violation or commission of another offense
2727 committed after the defendant completed the program; and
2828 (D) had a term of parole or mandatory supervision
2929 revoked due to a technical violation or commission of another
3030 offense committed after the defendant completed the program;
3131 (2) any apparent patterns in the recidivism rate for
3232 defendants based on the available information;
3333 (3) a summary of any information the council
3434 determines is correlated with or otherwise relevant to the
3535 recidivism rate for defendants; and
3636 (4) recommendations for:
3737 (A) further action to improve outcomes for
3838 defendants in the program; and
3939 (B) program goals to reduce the recidivism rate
4040 of defendants.
4141 (c) The council may collaborate with any state or federal
4242 agency, county, or court as necessary to obtain the information
4343 described by Subsection (b).
4444 (d) Not later than January 1, 2025, the council shall
4545 prepare and submit to the governor and the legislature a written
4646 report containing the results of the study and any recommendations
4747 for legislative or other action.
4848 (e) This section expires September 1, 2025.
4949 SECTION 2. This Act takes effect September 1, 2023.
