| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle B, Title 2, Utilities Code, is amended |
|---|
| 11 | 11 | | by adding Chapter 34 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 34. ON-SITE LOAD MITIGATION PROGRAM |
|---|
| 13 | 13 | | Sec. 34.0101. DEFINITION. In this chapter, "grant program" |
|---|
| 14 | 14 | | means the On-Site Load Mitigation Program. |
|---|
| 15 | 15 | | Sec. 34.0102. ON-SITE LOAD MITIGATION PROGRAM. (a) From |
|---|
| 16 | 16 | | funds appropriated for the purpose, the commission shall establish |
|---|
| 17 | 17 | | a grant program to provide grants that mitigate the demand for |
|---|
| 18 | 18 | | energy on the electric grid by supporting the use of advanced |
|---|
| 19 | 19 | | nuclear reactors and cogeneration facilities by facilities that |
|---|
| 20 | 20 | | require large-scale loads of electricity. |
|---|
| 21 | 21 | | (b) The commission by rule shall establish eligibility |
|---|
| 22 | 22 | | criteria for projects to receive a grant under this section, |
|---|
| 23 | 23 | | including requiring that a project must: |
|---|
| 24 | 24 | | (1) reduce load on the electric grid; or |
|---|
| 25 | 25 | | (2) prevent additional load from being demanded from |
|---|
| 26 | 26 | | the electric grid. |
|---|
| 27 | 27 | | Sec. 34.0103. RULEMAKING. The commission by rule shall |
|---|
| 28 | 28 | | implement and administer the grant program. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
