66 relating to the establishment of a ketamine treatment grant program
77 for veterans, active-duty military, and first responders.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1010 amended by adding Chapter 541 to read as follows:
1111 CHAPTER 54. KETAMINE TREATMENT GRANT PROGRAM
1212 Sec. 54.001. KETAMINE TREATMENT GRANT PROGRAM. The
1313 commission shall establish a ketamine treatment grant program for
1414 ketamine infusion clinics that serve veterans, active-duty
1515 military, and first responders.
1616 Sec. 542.002. USE OF GRANT. A ketamine infusion clinic
1717 awarded a grant under this chapter may use grant money to:
1818 (1) provide otherwise uncompensated treatment to:
1919 (i) veterans;
2020 (ii) active-duty military; and
2121 (iii) first responders; and
2222 (2) pay for other activities, services, supplies,
2323 resources, and equipment the commission determines necessary for
2424 the facility to provide these services.
2525 Sec. 54.003. SELECTION OF GRANT RECIPIENTS. The commission
2626 with any necessary assistance of physicians or other providers may
2727 select eligible facilities to receive a grant under this chapter.
2828 Sec. 54.004. GIFTS, GRANTS, AND DONATIONS. The commission
2929 may solicit and accept gifts, grants, and donations from any public
3030 or private source for the purposes of this chapter.
3131 Sec. 541.005. WORK GROUP. (a) The commission may establish
3232 a program work group to:
3333 (1) assist the commission with developing,
3434 implementing, or evaluating the program; and
3535 (2) prepare a report on the results and outcomes of the
3636 grants awarded under this chapter.
3737 (b) A member of a program work group established under this
3838 section is not entitled to compensation for serving on the program
3939 work group and may not be reimbursed for travel or other expenses
4040 incurred while conducting the business of the program work group.
4141 (c) A program work group established under this section is
4242 not subject to Chapter 2110.
4343 Sec. 541.006. REPORT TO GOVERNOR AND LEGISLATURE. Not
4444 later than December 1 of each even-numbered year, the commission
4545 shall submit a report to the governor and members of the legislature
4646 regarding the activities of the program and grant recipients,
4747 including the results and outcomes of grants awarded under this
4848 chapter.
4949 Sec. 541.007. RULES. The executive commissioner may adopt
5050 rules necessary to implement this chapter.
5151 Sec. 541.008. SPECIFIC APPROPRIATION REQUIRED. The
5252 commission may not spend state funds to accomplish the purposes of
5353 this chapter and is not required to award a grant under this chapter
5454 unless money is appropriated for the purposes of this chapter.
5555 SECTION 2. Not later than December 1, 2023, the Health and
5656 Human Services Commission shall establish and implement the
5757 ketamine treatment grant program authorized by Chapter 54, Health
5858 and Safety Code, as added by this Act.
5959 SECTION 3. Not later than December 1, 2024, the Health and
6060 Human Services Commission shall provide the initial report to the
6161 governor and the legislature as required by Section 54.006, Health &
6262 Safety Code, as added by this Act.
6363 SECTION 4. This Act takes effect September 1, 2023.
