6 | 6 | | relating to the establishment of a ketamine treatment grant program |

7 | 7 | | for veterans, active-duty military, and first responders. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subtitle B, Title 2, Health and Safety Code, is |
---|
10 | 10 | | amended by adding Chapter 541 to read as follows: |
---|
11 | 11 | | CHAPTER 54. KETAMINE TREATMENT GRANT PROGRAM |
---|
12 | 12 | | Sec. 54.001. KETAMINE TREATMENT GRANT PROGRAM. The |
---|
13 | 13 | | commission shall establish a ketamine treatment grant program for |
---|
14 | 14 | | ketamine infusion clinics that serve veterans, active-duty |
---|
15 | 15 | | military, and first responders. |
---|
16 | 16 | | Sec. 542.002. USE OF GRANT. A ketamine infusion clinic |
---|
17 | 17 | | awarded a grant under this chapter may use grant money to: |
---|
18 | 18 | | (1) provide otherwise uncompensated treatment to: |
---|
19 | 19 | | (i) veterans; |
---|
20 | 20 | | (ii) active-duty military; and |
---|
21 | 21 | | (iii) first responders; and |
---|
22 | 22 | | (2) pay for other activities, services, supplies, |
---|
23 | 23 | | resources, and equipment the commission determines necessary for |
---|
24 | 24 | | the facility to provide these services. |
---|
25 | 25 | | Sec. 54.003. SELECTION OF GRANT RECIPIENTS. The commission |
---|
26 | 26 | | with any necessary assistance of physicians or other providers may |
---|
27 | 27 | | select eligible facilities to receive a grant under this chapter. |
---|
28 | 28 | | Sec. 54.004. GIFTS, GRANTS, AND DONATIONS. The commission |
---|
29 | 29 | | may solicit and accept gifts, grants, and donations from any public |
---|
30 | 30 | | or private source for the purposes of this chapter. |
---|
31 | 31 | | Sec. 541.005. WORK GROUP. (a) The commission may establish |
---|
32 | 32 | | a program work group to: |
---|
33 | 33 | | (1) assist the commission with developing, |
---|
34 | 34 | | implementing, or evaluating the program; and |
---|
35 | 35 | | (2) prepare a report on the results and outcomes of the |
---|
36 | 36 | | grants awarded under this chapter. |
---|
37 | 37 | | (b) A member of a program work group established under this |
---|
38 | 38 | | section is not entitled to compensation for serving on the program |
---|
39 | 39 | | work group and may not be reimbursed for travel or other expenses |
---|
40 | 40 | | incurred while conducting the business of the program work group. |
---|
41 | 41 | | (c) A program work group established under this section is |
---|
42 | 42 | | not subject to Chapter 2110. |
---|
43 | 43 | | Sec. 541.006. REPORT TO GOVERNOR AND LEGISLATURE. Not |
---|
44 | 44 | | later than December 1 of each even-numbered year, the commission |
---|
45 | 45 | | shall submit a report to the governor and members of the legislature |
---|
46 | 46 | | regarding the activities of the program and grant recipients, |
---|
47 | 47 | | including the results and outcomes of grants awarded under this |
---|
48 | 48 | | chapter. |
---|
49 | 49 | | Sec. 541.007. RULES. The executive commissioner may adopt |
---|
50 | 50 | | rules necessary to implement this chapter. |
---|
51 | 51 | | Sec. 541.008. SPECIFIC APPROPRIATION REQUIRED. The |
---|
52 | 52 | | commission may not spend state funds to accomplish the purposes of |
---|
53 | 53 | | this chapter and is not required to award a grant under this chapter |
---|
54 | 54 | | unless money is appropriated for the purposes of this chapter. |
---|
55 | 55 | | SECTION 2. Not later than December 1, 2023, the Health and |
---|
56 | 56 | | Human Services Commission shall establish and implement the |
---|
57 | 57 | | ketamine treatment grant program authorized by Chapter 54, Health |
---|
58 | 58 | | and Safety Code, as added by this Act. |
---|
59 | 59 | | SECTION 3. Not later than December 1, 2024, the Health and |
---|
60 | 60 | | Human Services Commission shall provide the initial report to the |
---|
61 | 61 | | governor and the legislature as required by Section 54.006, Health & |
---|
62 | 62 | | Safety Code, as added by this Act. |
---|
63 | 63 | | SECTION 4. This Act takes effect September 1, 2023. |
