| 5 | 5 | | relating to the criteria and qualifications for distributions under |

| 6 | 6 | | the rural volunteer fire department assistance program. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 614.102(c), Government Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | (c) The director shall: |
|---|
| 11 | 11 | | (1) determine reasonable criteria and qualifications |
|---|
| 12 | 12 | | for the distribution of money from the volunteer fire department |
|---|
| 13 | 13 | | assistance fund, including: |
|---|
| 14 | 14 | | (A) the frequency, size, and severity of past |
|---|
| 15 | 15 | | wildfires in a volunteer fire department's jurisdiction; |
|---|
| 16 | 16 | | (B) the potential for loss or damage to property |
|---|
| 17 | 17 | | resulting from future wildfires in the department's jurisdiction; |
|---|
| 18 | 18 | | [and] |
|---|
| 19 | 19 | | (C) the age of the equipment used by the |
|---|
| 20 | 20 | | department; and |
|---|
| 21 | 21 | | (D) the department's need for emergency |
|---|
| 22 | 22 | | assistance under Section 614.103(a-1); and |
|---|
| 23 | 23 | | (2) establish a procedure for reporting and processing |
|---|
| 24 | 24 | | requests for money from the fund. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
