77 relating to exceptions to municipal plat requirements for certain

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 212.0046, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 212.0046. EXCEPTION TO PLAT REQUIREMENT: CERTAIN
1313 PROPERTY ABUTTING AIRCRAFT RUNWAY. An owner of a tract of land is
1414 not required to prepare a plat if the land:
1515 (1) is located wholly within a municipality with a
1616 population of 65,000 [5,000] or less;
1717 (2) is divided into parts larger than 2-1/2 acres; and
1818 (3) abuts any part of an aircraft runway.
1919 SECTION 2. Subchapter B, Chapter 212, Local Government
2020 Code, is amended by adding Section 212.0455 to read as follows:
2121 Sec. 212.0455. EXCEPTION TO PLAT REQUIREMENT: MUNICIPAL
2222 DETERMINATION. To determine whether specific developments of
2323 tracts of land are required to be platted under this subchapter, a
2424 municipality may define and classify the developments. A
2525 municipality need not require platting for every development of a
2626 tract of land otherwise within the scope of this subchapter.
2727 SECTION 3. This Act takes effect September 1, 2023.
