55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the contents of the annual child fatality report
88 published by the Department of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 261.204(b), Family Code, is amended to
1111 read as follows:
1212 (b) The report published under Subsection (a) must:
1313 (1) accurately represent all abuse-related and
1414 neglect-related child fatalities in this state, including child
1515 fatalities investigated under Subchapter F, Chapter 264, and other
1616 child fatalities investigated by the department; [and]
1717 (2) aggregate the fatalities by investigative
1818 findings and case disposition, including the following
1919 dispositions:
2020 (A) abuse and neglect ruled out;
2121 (B) unable to determine cause of death;
2222 (C) reason to believe abuse or neglect occurred;
2323 (D) reason to believe abuse or neglect
2424 contributed to child's death;
2525 (E) unable to complete review; and
2626 (F) administrative closure; and
2727 (3) aggregate the fatalities by cause of death, if
2828 determinable, including:
2929 (A) accidental drowning or submersion;
3030 (B) assault by drowning or submersion;
3131 (C) discharge of a firearm;
3232 (D) drug overdose;
3333 (E) assault by other physical means, including
3434 strangulation or suffocation;
3535 (F) accidental suffocation;
3636 (G) exposure to smoke, fire, or flames;
3737 (H) malnutrition;
3838 (I) deprivation of medical care;
3939 (J) motor vehicle accident;
4040 (K) heatstroke caused by being left in a motor
4141 vehicle; or
4242 (L) sudden infant death syndrome.
4343 SECTION 2. This Act takes effect September 1, 2023.
