55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the incentive for public schools that provide
88 additional instructional days for certain students and the early
99 education allotment under the Foundation School Program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 48.0051(a), (b), and (d), Education
1212 Code, are amended to read as follows:
1313 (a) The [Subject to Subsection (a-1), the] commissioner
1414 shall adjust the average daily attendance of a school district or
1515 open-enrollment charter school under Section 48.005 in the manner
1616 provided by Subsection (b) if the district or school:
1717 (1) provides the minimum number of minutes of
1818 operational and instructional time required under Section 25.081
1919 and commissioner rules adopted under that section over at least 175
2020 [180] days of instruction; and
2121 (2) offers an additional 30 days of half-day
2222 instruction for students enrolled in prekindergarten through fifth
2323 grade.
2424 (b) For a school district or open-enrollment charter school
2525 described by Subsection (a), the commissioner shall increase the
2626 average daily attendance of the district or school under Section
2727 48.005 by the amount that results from the quotient of the sum of
2828 attendance by students described by Subsection (a)(2) for each of
2929 the 30 additional instructional days of half-day instruction that
3030 are provided divided by 175 [180].
3131 (d) This section does not prohibit a school district from
3232 providing the minimum number of minutes of operational and
3333 instructional time required under Section 25.081 and commissioner
3434 rules adopted under that section over fewer than 175 [180] days of
3535 instruction.
3636 SECTION 2. Section 48.108, Education Code, is amended by
3737 adding Subsection (a-1) to read as follows:
3838 (a-1) In addition to the allotment under Subsection (a), a
3939 school district is entitled to an annual allotment equal to the
4040 basic allotment multiplied by 0.1 for each student in average daily
4141 attendance in a prekindergarten class who meets the eligibility
4242 requirements under Section 29.153(b) and is at least four years of
4343 age.
4444 SECTION 3. This Act takes effect September 1, 2023.
