| 7 | 7 | | relating to the incentive for public schools that provide |

| 8 | 8 | | additional instructional days for certain students and the early |
|---|
| 9 | 9 | | education allotment under the Foundation School Program. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 48.0051(a), (b), and (d), Education |
|---|
| 12 | 12 | | Code, are amended to read as follows: |
|---|
| 13 | 13 | | (a) The [Subject to Subsection (a-1), the] commissioner |
|---|
| 14 | 14 | | shall adjust the average daily attendance of a school district or |
|---|
| 15 | 15 | | open-enrollment charter school under Section 48.005 in the manner |
|---|
| 16 | 16 | | provided by Subsection (b) if the district or school: |
|---|
| 17 | 17 | | (1) provides the minimum number of minutes of |
|---|
| 18 | 18 | | operational and instructional time required under Section 25.081 |
|---|
| 19 | 19 | | and commissioner rules adopted under that section over at least 175 |
|---|
| 20 | 20 | | [180] days of instruction; and |
|---|
| 21 | 21 | | (2) offers an additional 30 days of half-day |
|---|
| 22 | 22 | | instruction for students enrolled in prekindergarten through fifth |
|---|
| 23 | 23 | | grade. |
|---|
| 24 | 24 | | (b) For a school district or open-enrollment charter school |
|---|
| 25 | 25 | | described by Subsection (a), the commissioner shall increase the |
|---|
| 26 | 26 | | average daily attendance of the district or school under Section |
|---|
| 27 | 27 | | 48.005 by the amount that results from the quotient of the sum of |
|---|
| 28 | 28 | | attendance by students described by Subsection (a)(2) for each of |
|---|
| 29 | 29 | | the 30 additional instructional days of half-day instruction that |
|---|
| 30 | 30 | | are provided divided by 175 [180]. |
|---|
| 31 | 31 | | (d) This section does not prohibit a school district from |
|---|
| 32 | 32 | | providing the minimum number of minutes of operational and |
|---|
| 33 | 33 | | instructional time required under Section 25.081 and commissioner |
|---|
| 34 | 34 | | rules adopted under that section over fewer than 175 [180] days of |
|---|
| 35 | 35 | | instruction. |
|---|
| 36 | 36 | | SECTION 2. Section 48.108, Education Code, is amended by |
|---|
| 37 | 37 | | adding Subsection (a-1) to read as follows: |
|---|
| 38 | 38 | | (a-1) In addition to the allotment under Subsection (a), a |
|---|
| 39 | 39 | | school district is entitled to an annual allotment equal to the |
|---|
| 40 | 40 | | basic allotment multiplied by 0.1 for each student in average daily |
|---|
| 41 | 41 | | attendance in a prekindergarten class who meets the eligibility |
|---|
| 42 | 42 | | requirements under Section 29.153(b) and is at least four years of |
|---|
| 43 | 43 | | age. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2023. |
