55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the purchase of service credit in the Employees
88 Retirement System of Texas by members of the Texas military forces.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 813, Government Code, is
1111 amended by adding Section 813.300 to read as follows:
1212 Sec. 813.300. DEFINITIONS. In this subchapter, "state
1313 active duty," "state training and other duty," and "Texas military
1414 forces" have the meanings assigned by Section 437.001.
1515 SECTION 2. Section 813.301(a), Government Code, is amended
1616 to read as follows:
1717 (a) Military service creditable in the retirement system
1818 is:
1919 (1) active federal duty as a member of the armed forces
2020 of the United States; or
2121 (2) state active duty or state training and other
2222 duty, as a member of the Texas military forces.
2323 SECTION 3. Section 813.304(b), Government Code, is amended
2424 to read as follows:
2525 (b) The retirement system shall use military service credit
2626 in computing service retirement or nonoccupational disability
2727 retirement benefits of a member of the employee class, regardless
2828 of the amount of service credit the member has in that class [only
2929 if the member has, without military service credit, at least five
3030 years of service credit in that class].
3131 SECTION 4. This Act takes effect September 1, 2023.
