55 AN ACT
66 relating to the residence address of an applicant for purposes of
77 voter registration.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 13.001, Election Code, is amended by
1010 adding subsection (d) as follows:
1111 Sec. 13.001. ELIGIBILITY FOR REGISTRATION. (a) To be
1212 eligible for registration as a voter in this state, a person must:
1313 (1) be 18 years of age or older;
1414 (2) be a United States citizen;
1515 (3) not have been determined by a final judgment of a
1616 court exercising probate jurisdiction to be:
1717 (A) totally mentally incapacitated; or
1818 (B) partially mentally incapacitated without the
1919 right to vote;
2020 (4) not have been finally convicted of a felony or, if
2121 so convicted, must have:
2222 (A) fully discharged the person's sentence,
2323 including any term of incarceration, parole, or supervision, or
2424 completed a period of probation ordered by any court; or
2525 (B) been pardoned or otherwise released from the
2626 resulting disability to vote; and
2727 (5) be a resident of the county in which application
2828 for registration is made.
2929 (b) To be eligible to apply for registration, a person must,
3030 on the date the registration application is submitted to the
3131 registrar, be at least 17 years and 10 months of age and satisfy the
3232 requirements of Subsection (a) except for age.
3333 (c) For purposes of Subsection (a)(4), a person is not
3434 considered to have been finally convicted of an offense for which
3535 the criminal proceedings are deferred without an adjudication of
3636 guilt.
3737 (d) To be eligible to apply for registration at a residence,
3838 the person must habitually sleep at that residence. A person whose
3939 residence has an address is only eligible to register at that
4040 address and is not eligible to register at any other place.
4141 SECTION 2. Section 13.002(c), Election Code, is amended to
4242 read as follows:
4343 (c) A registration application must include:
4444 (1) the applicant's first name, middle name, if any,
4545 last name, and former name, if any;
4646 (2) the month, day, and year of the applicant's birth;
4747 (3) a statement that the applicant is a United States
4848 citizen;
4949 (4) a statement that the applicant is a resident of the
5050 county;
5151 (5) a statement that the applicant has not been
5252 determined by a final judgment of a court exercising probate
5353 jurisdiction to be:
5454 (A) totally mentally incapacitated; or
5555 (B) partially mentally incapacitated without the
5656 right to vote;
5757 (6) a statement that the applicant has not been
5858 finally convicted of a felony or that the applicant is a felon
5959 eligible for registration under Section 13.001;
6060 (7) the applicant's residence address under Section
6161 13.001(d) or, if the residence has no address:[,]
6262 (A) the address at which the applicant receives
6363 mail;
6464 (B) [and] a concise description of the location
6565 of the applicant's residence; and
6666 (C) a statement that the applicant's residence
6767 has no address;
6868 (8) the following information:
6969 (A) the applicant's Texas driver's license number
7070 or the number of a personal identification card issued by the
7171 Department of Public Safety;
7272 (B) if the applicant has not been issued a number
7373 described by Paragraph (A), the last four digits of the applicant's
7474 social security number; or
7575 (C) a statement by the applicant that the
7676 applicant has not been issued a number described by Paragraph (A) or
7777 (B);
7878 (9) if the application is made by an agent, a statement
7979 of the agent's relationship to the applicant; and
8080 (10) the city and county in which the applicant
8181 formerly resided.
8282 SECTION 3. This Act takes effect September 1, 2023.
