5	5	relating to licenses and similar documents issued by certain
6	6	foreign governments.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 37.01(2), Penal Code, is amended to read
9	9	as follows:
10	10	(2) "Governmental record" means:
11	11	(A) anything belonging to, received by, or kept
12	12	by government for information, including a court record;
13	13	(B) anything required by law to be kept by others
14	14	for information of government;
15	15	(C) a license, certificate, permit, seal, title,
16	16	letter of patent, or similar document issued by government, by
17	17	another state, [or] by the United States, or by a foreign government
18	18	engaged in a reciprocal treaty or memorandum of understanding with
19	19	the United States;
20	20	(D) a standard proof of motor vehicle liability
21	21	insurance form described by Section 601.081, Transportation Code, a
22	22	certificate of an insurance company described by Section 601.083 of
23	23	that code, a document purporting to be such a form or certificate
24	24	that is not issued by an insurer authorized to write motor vehicle
25	25	liability insurance in this state, an electronic submission in a
26	26	form described by Section 502.046(i), Transportation Code, or an
27	27	evidence of financial responsibility described by Section 601.053
28	28	of that code;
29	29	(E) an official ballot or other election record;
30	30	or
31	31	(F) the written documentation a mobile food unit
32	32	is required to obtain under Section 437.0074, Health and Safety
33	33	Code.
34	34	SECTION 2. Section 522.015, Transportation Code, is amended
35	35	to read as follows:
36	36	Sec. 522.015. LICENSE OR PERMIT ISSUED BY OTHER
37	37	JURISDICTION. (a) Subject to Subsection (b), a [A] person may
38	38	drive a commercial motor vehicle in this state if:
39	39	(1) either:
40	40	(A) the person has a commercial driver's license
41	41	or a commercial learner's permit issued by [:
42	42	[(A)] another state in accordance with the
43	43	minimum federal standards for the issuance of a commercial motor
44	44	vehicle driver's license; or
45	45	(B) the person:
46	46	(i) has a commercial driver's license or a
47	47	commercial learner's permit issued by a foreign jurisdiction the
48	48	testing and licensing standards of which the United States
49	49	Department of Transportation has determined meet the requirements
50	50	of the federal act; and
51	51	(ii) is authorized under federal law to
52	52	work in the United States;
53	53	(2) the person's license or permit is appropriate for
54	54	the class of vehicle being driven;
55	55	(3) the person is not disqualified from driving a
56	56	commercial motor vehicle and is not subject to an out-of-service
57	57	order;
58	58	(4) the person has not had a domicile in this state for
59	59	more than 30 days; and
60	60	(5) if the person has a permit, the person also has a
61	61	driver's license issued by the same jurisdiction that issued the
62	62	permit.
63	63	(b) If a person has a commercial driver's license or a
64	64	commercial learner's permit described by Subsection (a)(1)(B)(i)
65	65	and is not authorized under federal law to work in the United States
66	66	but satisfies all of the other requirements of Subsection (a), the
67	67	person may drive a commercial motor vehicle only in a county
68	68	bordering the United Mexican States.
69	69	SECTION 3. The change in law made by this Act applies only
70	70	to an offense committed on or after the effective date of this Act.
71	71	An offense committed before the effective date of this Act is
72	72	governed by the law in effect on the date the offense was committed,
73	73	and the former law is continued in effect for that purpose. For
74	74	purposes of this section, an offense was committed before the
75	75	effective date of this Act if any element of the offense occurred
76	76	before that date.
77	77	SECTION 4. This Act takes effect September 1, 2023.
