55 relating to licenses and similar documents issued by certain
66 foreign governments.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 37.01(2), Penal Code, is amended to read
99 as follows:
1010 (2) "Governmental record" means:
1111 (A) anything belonging to, received by, or kept
1212 by government for information, including a court record;
1313 (B) anything required by law to be kept by others
1414 for information of government;
1515 (C) a license, certificate, permit, seal, title,
1616 letter of patent, or similar document issued by government, by
1717 another state, [or] by the United States, or by a foreign government
1818 engaged in a reciprocal treaty or memorandum of understanding with
1919 the United States;
2020 (D) a standard proof of motor vehicle liability
2121 insurance form described by Section 601.081, Transportation Code, a
2222 certificate of an insurance company described by Section 601.083 of
2323 that code, a document purporting to be such a form or certificate
2424 that is not issued by an insurer authorized to write motor vehicle
2525 liability insurance in this state, an electronic submission in a
2626 form described by Section 502.046(i), Transportation Code, or an
2727 evidence of financial responsibility described by Section 601.053
2828 of that code;
2929 (E) an official ballot or other election record;
3030 or
3131 (F) the written documentation a mobile food unit
3232 is required to obtain under Section 437.0074, Health and Safety
3333 Code.
3434 SECTION 2. Section 522.015, Transportation Code, is amended
3535 to read as follows:
3636 Sec. 522.015. LICENSE OR PERMIT ISSUED BY OTHER
3737 JURISDICTION. (a) Subject to Subsection (b), a [A] person may
3838 drive a commercial motor vehicle in this state if:
3939 (1) either:
4040 (A) the person has a commercial driver's license
4141 or a commercial learner's permit issued by [:
4242 [(A)] another state in accordance with the
4343 minimum federal standards for the issuance of a commercial motor
4444 vehicle driver's license; or
4545 (B) the person:
4646 (i) has a commercial driver's license or a
4747 commercial learner's permit issued by a foreign jurisdiction the
4848 testing and licensing standards of which the United States
4949 Department of Transportation has determined meet the requirements
5050 of the federal act; and
5151 (ii) is authorized under federal law to
5252 work in the United States;
5353 (2) the person's license or permit is appropriate for
5454 the class of vehicle being driven;
5555 (3) the person is not disqualified from driving a
5656 commercial motor vehicle and is not subject to an out-of-service
5757 order;
5858 (4) the person has not had a domicile in this state for
5959 more than 30 days; and
6060 (5) if the person has a permit, the person also has a
6161 driver's license issued by the same jurisdiction that issued the
6262 permit.
6363 (b) If a person has a commercial driver's license or a
6464 commercial learner's permit described by Subsection (a)(1)(B)(i)
6565 and is not authorized under federal law to work in the United States
6666 but satisfies all of the other requirements of Subsection (a), the
6767 person may drive a commercial motor vehicle only in a county
6868 bordering the United Mexican States.
6969 SECTION 3. The change in law made by this Act applies only
7070 to an offense committed on or after the effective date of this Act.
7171 An offense committed before the effective date of this Act is
7272 governed by the law in effect on the date the offense was committed,
7373 and the former law is continued in effect for that purpose. For
7474 purposes of this section, an offense was committed before the
7575 effective date of this Act if any element of the offense occurred
7676 before that date.
7777 SECTION 4. This Act takes effect September 1, 2023.
